CONSIDER APPROVAL OF FUNDING AGREEMENT BETWEEN LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY (METRO) AND THE CITY OF CARSON ACCEPTING MEASURE R FUNDING IN THE AMOUNT OF $ 4,220,000.00 FOR PROJECT NO. 1657: TRAFFIC SIGNAL UPGRADES - FIGUEROA ST AT 234TH ST, FIGUEROA ST AT 223RD ST, FIGUEROA ST AT VICTORIA ST / 190TH ST, MAIN ST AT 220TH ST, MAIN ST AT ALBERTONI ST, AND MAIN ST AT VICTORIA ST.

I.                     SUMMARY

The City of Carson (City) is planning to undertake Project No. 1657: Traffic Signal Upgrades (Project) - Figueroa St at 234th St, Figueroa St at 223rd St, Figueroa St at Victoria St / 190th St, Main St at 220th St, Main St at Albertoni St, and Main St at Victoria St. (Exhibit No. 1).

Grant funds from Los Angeles County Metropolitan Transportation Authority (Metro) Measure “R” funds in the amount of $4,220,000 were awarded to the City in accordance with the terms of the Funding Agreement, to cover 100% of the estimated cost of this project which includes $300,000 for preliminary engineering already completed by Metro, an additional $190,000 for construction support to be expended by Metro, and $3,730,000 for the construction phase to be conducted by the City. After deducting these amounts for engineering and construction support, the grant funds remaining and available to be used toward the construction of Project are in the amount of $3,730,000.

The Metro Board requires the execution of the Funding Agreement between the City and Metro, and staff now seeks City Council approval of  the same to fund the project.

II.                     RECOMMENDATION

Recommendation

                     TAKE the following actions:

1.                     ACCEPT a grant in the amount of $4,220,000.00 from Los Angeles County Metropolitan Transportation Authority.

2.                     APPROVE the Funding Agreement between Los Angeles County Metropolitan Transportation Authority and the City of Carson granting $3,730,000 to the City of Carson to cover the project construction cost.

 

3.                     AUTHORIZE the Mayor to execute the Funding Agreement between Los Angeles County Metropolitan Transportation Authority and the City of Carson following approval as to form by the City Attorney.

III.                     ALTERNATIVES

DO NOT APPROVE the Funding Agreement; however, the City must execute this funding agreement in order to receive grant funds for this project. Invoices for reimbursement cannot be submitted to Metro until this funding agreement is fully executed.

IV.                     BACKGROUND

The City’s Capital Improvement Program (CIP) calls for the design and construction of Project No. 1657: Traffic Signal Upgrades - Figueroa St at 234th St, Figueroa St at 223rd St, Figueroa St at Victoria St / 190th St, Main St at 220th St, Main St at Albertoni St, and Main St at Victoria St.

In June 2016, the Metro Board programmed $1,400,000 in Measure R Funds for the design and construction of the project. The Metro Board also authorized Metro staff to manage and complete the design for the project at its January 23, 2020, meeting. Given that the amount Metro programmed in 2016 was insufficient to cover the project construction cost, staff applied for more Metro grant funding. On July 22, 2021, the Metro Board programmed an additional $2,820,000 in Measure R Funds for the City for construction of the project.

Grant funds were awarded to the City to cover 100% of the estimated cost of this project from Metro Measure “R” funds in the amount of $4,220,000 in accordance with the terms of the Funding Agreement (Exhibit No. 2) which includes $300,000 for preliminary engineering already completed by LACMTA, an additional $190,000 for construction support during the construction phase to be expended by Metro, and $3,730,000 for the construction phase to be conducted by the City. After deducting these amounts for engineering and construction support, the grant funds remaining and available to be used toward the construction of the project are in the amount of $3,730,000 and staff now seeks City Council approval of a Funding Agreement with Metro for a grant to City in the amount of $3,730,000 made on a reimbursement basis. Essentially, while the entire grant amount of $4,220,000 will be on a reimbursement basis, because Metro performed work on City’s behalf acting as City’s consultant, the cost of the engineering design and construction support will be deemed as though they are part of the reimbursement process but the actual reimbursement for such costs will not be made and instead, only the construction cost of $3,730,000 will be accounted for in the Funding Agreement.

The plans, specifications, and estimates for this project were approved at City Council on February 23, 2023.

 

Staff is requesting the City Council to approve the Funding Agreement between Los Angeles County Metropolitan Transportation Authority and the City of Carson attached as an exhibit to this staff report.

V.                     FISCAL IMPACT

There is no fiscal impact to the General Fund. The grant for $4,220,000 would cover 100% of the project cost. The total cost of the project is estimated at $4,220,000, including $490,000 of engineering and construction support already conducted by Metro.  The grant funds will be paid on a reimbursement basis in accordance with the provisions of the Funding Agreement. It is requested that $1,000,000 be programmed in the proposed 5-year CIP for FY 23/24 for account 254-80-820-904-8023. The estimated cost of the project is broken down below:
