CONSIDER AWARDING A PUBLIC WORKS MAINTENANCE CONTRACT TO SWAYZER CORPORATION TO PROVIDE MEDIAN LANDSCAPING SERVICES

 

Body

I.                     SUMMARY

Due to the recent above average rainfall, medians were minimally maintained which then caused overgrown weeds. To immediately address such concerns from the community, an arrangement with a local contractor was made to assist city crews with the urgent need to improve the aesthetics of the medians.

Staff recommends that the City Council approve the proposed contract with Swayzer Corporation at the current contract terms at a rate not-to-exceed $60,000. The term of the contract will expire June 30, 2023 giving staff sufficient time to award a larger city-wide maintenance contract after issuance of an RFP.

II.                     RECOMMENDATION

Recommendation

1.                     AWARD and APPROVE the proposed contract with Swayzer Corporation to provide median landscaping services in an amount not-to-exceed $60,000 (Exhibit 1).

 

2.                     AUTHORIZE Mayor to execute the Agreement following approval as to form by the City Attorney.

IV.                     BACKGROUND

The previous median maintenance contract lapsed and due to the recent amounts of rainfall, medians were minimally maintained which then caused overgrown weeds. To immediately address such concerns from the community, an arrangement with a local contractor was made to assist city crews with the urgent need to improve the aesthetics of the medians.

Staff is proposing that City enter into a contract with Swayzer Corporation for a not-to-exceed contract sum of $60,000. The term of the contract will expire June 30, 2023 giving staff sufficient time to award a larger city-wide maintenance contract after issuance of an RFP.

The proposed maintenance project is subject to the State bidding laws known as the Uniform Public Construction Cost Accounting Act (UPCCAA) adopted by the City as set forth in Section 2612 of its Municipal Code. Under UPCCAA, maintenance work of $60,000 or less have no bidding requirement attached to it. The City Council is now being asked to award a contract to Swayzer Corporation for an amount not to exceed $60,000.00. Swayzer Corporation is a qualified licensed contractor with whom City staff has worked extensively in the past, including under a contract that recently expired December 2022.

 

V.                     FISCAL IMPACT

None. The funding requested for this Contract Agreement for $60,000 is budgeted in the General Fund account no. 101-80-840-108-6004. The total amount requested for this project is $60,000.00.
