CONSIDER ADOPTION OF RESOLUTION NO. 23-067 “A RESOLUTION OF THE CITY OF CARSON CITY COUNCIL AMENDING THE FISCAL YEAR 2022-23 BUDGET IN THE SPECIAL REVENUE FUNDS" FOR PROJECT NO. 1606: 223RD STREET WIDENING.

I.                     SUMMARY

On January 3rd, 2023, the City Council approved Resolution No. 23-001 to allocate funds from the SB1 Fund balance to cover unforeseen construction costs and complete construction of CIP Project No. 1606: 223rd Street Widening and Pavement Rehabilitation. Resolution No. 23-001 contained incomplete information resulting in the need to clarify that in addition to the SB1 fund, these unforeseen construction costs must also be covered with funds from the Measure R Highway Program Fund. Additionally, the allocation of Metropolitan Water District (MWD) reimbursement to the project funds is needed to cover the work performed by MWD. Therefore, city staff proposes that City Council adopt Resolution 23-067 to ensure that the appropriate funds are allocated to Project No. 1606: 223rd Street Widening and Pavement Rehabilitation. This Resolution when adopted will replace and supersede Resolution No. 23-001 previously adopted by the City Council.

 

II.                     RECOMMENDATION

Recommendation

TAKE the following action:

 

1.                     ADOPT Resolution No. 23-067, “A Resolution of the City Council of the City of Carson amending the fiscal year 2022-23 budget in the Special Revenue Funds” appropriating $120,000 from Measure R HWY Program Fund, $55,000 from SB1 Fund, and $73,319.31 from MWD reimbursement fund to cover pending change orders, other additional work, and other unforeseen construction work that may be required to complete Project No. 1606: 223rd Street Widening and Pavement Rehabilitation from Wilmington Avenue to the East City limit. (Exhibit 1)

III.                     ALTERNATIVES

1.                     DO NOT ADOPT Resolution No. 23-067, however, this alternative may not allow for the full completion of the scope of work for the project as planned.

 

2.                     TAKE another action the City Council deems appropriate consistent with the requirements of the law.

 

IV.                     BACKGROUND

Project No. 1606: 223rd Street Widening and Pavement Rehabilitation is nearing its completion. On January 3, 2023, the City Council approved Resolution No. 23-001, which allocated $175,000 from the SB1 Fund balance to complete CIP Project No. 1606: 223rd Street Widening and Pavement Rehabilitation.

Unfortunately, it has come to light that a resolution with incomplete information was presented to City Council, which resulted in an inaccurate depiction of the allocation of funding sources for the project. The allocation of the $175,000 funding should not only be coming from the SB1 fund balance; it should also come from Measure R Highway Program Fund with an amount of $120,000, and from SB1 fund with an amount of $55,000.00 to cover pending change orders, and other unforeseen construction work that may be required to complete Project No. 1606: 223rd Street Widening and Pavement Rehabilitation from Wilmington Avenue to the East City limit. Additionally, the allocation of MWD reimbursement to the project funds that will help cover the relocation of MWD vent stack performed by the contractor for MWD should also be included in the Resolution.

Staff therefore requests that the City Council adopt Resolution No. 23-067 to settle all funds needed to complete the project.

 

V.                     FISCAL IMPACT

There is no impact to the general fund. Funds in the amount of $120,000 were allocated in Fund 259 (Measure R HWY Program) and was assigned to project number 1606 in the 5-year CIP plan. If staff recommendation is approved, $120,000 will be transferred from account 259-99-999-999-3910 to account 259-80-820-904-8009 as identified in exhibit 1 -resolution no. 23-067

A reimbursement from Metropolitan Water District in the amount of 73,319.31 was deposited into account 259-99-999-999-3910 for Project 1606. Staff is recommending that this same amount to be appropriated to the expense account 259-80-820-904-8009 as specified in Resolution No. 23-067.

Funds in the amount of $55,000 were allocated in Fund 288 (PRA2017SB1) and were assigned to project number 1606 in the 5-year CIP plan. If approved, staff is requesting to transfer $55,000 from account 288-99-999-999-3910 to account 288-80-820-904-8009.
