CONSIDER ADOPTION OF RESOLUTION NO. 23-069 TO APPROVE FILING OF GRANT PROJECT APPLICATIONS AND RELATED ACTIONS AS NECESSARY FOR ACCEPTANCE AND USE OF $7,000,000 IN GRANT FUNDS AWARDED TO THE CITY FROM THE STATE ASSEMBLY BUDGET ACT OF 2022, AB 179, FOR CITY FACILITIES, PARKS, AND COMMUNITY INFRASTRUCTURE (CITY COUNCIL)

I.                     SUMMARY

The City of Carson was recently notified that it had been awarded a $7 million grant through support by Assemblyman Mike Gipson, District 64, to be used for City facilities, parks, and community infrastructure.  To develop and submit the grant project application(s) and grant agreement that will ultimately allow the acceptance and utilization of the grant funds by the City, the City Council must approve Resolution No. 23-069 (Exhibit No. 1).  The grant will be used to support the Carriage Crest Expansion Project, which was previously awarded a $6 million grant from the efforts of Assemblyman Mike Gipson. 

 

II.                     RECOMMENDATION

ADOPT Resolution No. 23-069, “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON APPLICATION(S) FOR SPECIFIED GRANT FUNDS FROM BUDGET ACT OF 2022, AB179, CHAPTER 249, CONTROL SECTION 19.56, ITEM 3790-101-0001(K) OTHER COMMUNITY SERVICES, (20) $7,000,000 TO THE CITY OF CARSON FOR THE CITY FACILITIES, PARKS, AND COMMUNITY INFRASTRUCTURE”.

III.                     ALTERNATIVES

TAKE any other action the City Council deems appropriate.

IV.                     BACKGROUND

The City of Carson was informed that it had been awarded a grant in the amount of $7 million allocated through the State Assembly Budget Act of 2022, AB179, Chapter 249, and obtained with the support of Assemblyman Mike A. Gipson, District 64. The money must be used for City facilities, parks, and community infrastructure; specifically, to provide additional funding for the Carriage Crest Park Expansion Project.  In 2021, the City of Carson was awarded a $6 million grant from the efforts of Assemblyman Mike Gipson.

 

The grant is administered by the State of California Department of Parks and Recreation, Office of Grants and Local Services (OGALS). The agency is charged with developing grant programs that provide funding for local, state, and nonprofit organizations that generally address park, recreation, and resources-related needs. To commence the process - application development and submission; contract generation; grant acceptance - that will allow the City to utilize the funds, the City Council is asked to approve Resolution No. 23-069, which is an OGALS form resolution that OGALS requires the City to adopt to move forward. According to OGALS staff, they will need to secure the grant in their Fiscal system by signing a grant agreement no later than April 14, 2023, and they can only generate the contract once the complete resolution is received.

 

The proposed resolution, among other things, delegates Council authority to the City Manager or designee to conduct all negotiations and sign and submit all documents, including applications, agreements, amendments, and payment requests, which may be necessary for the completion of the project scope(s).

 

The resolution also states that the Council certifies “the applicant has reviewed, understands and agrees to the General Provisions contained in the contract shown in this Procedural Guide.” The Procedural Guide is attached to this report as Exhibit No. 2. The General Provisions (of OGALS’ sample Grant Contract) are set forth on pages 20-25 of the Procedural Guide, and include provisions such as:

  • City shall comply with CEQA and other applicable laws (subsection (B)(3)-(4));
  • City waives claims against the State related to the grant contract (subsection (G)(1));
  • City indemnifies, defends and holds State harmless from claims related to acquisition, development, construction, operation or maintenance of the property described as the project (subsection (G)(2)-(3));
  • City shall maintain satisfactory financial records and other records as the State shall prescribe for five years after project completion and make them available for State inspection (subsection (H));
  • City shall retain control of the property developed with grant monies for the duration of the contract performance period (subsection (I)(1)-(3)), and after project commencement, can only rescind the grant contract with approval from the State (subsection (E)(2)); and
  • State disclaims liability for assuring the safety or standards of construction, site improvements or programs related to the grant scope, and requires City to ensure any contractor hired has adequate insurance for potential loss associated with the grant project (subsection (L)).

 

V.                     FISCAL IMPACT

Although there is no fiscal impact in the 2022-2023 General Fund operating budget, staff will include the $7 million anticipated expenditure and projected revenue in the Fiscal Year 2023-2024 Capital Improvement Program for City Council consideration in an upcoming budget workshop.
