CONSIDER AWARDING A PUBLIC WORKS CONTRACT TO BARKSHIRE LASER LEVELING INC. TO LASER LEVEL THE BASEBALL DIAMOND INFIELDS AT DOMINGUEZ PARK AND DOLPHIN PARK.

I. SUMMARY
The existing baseball diamond infields at Dominguez Park and Dolphin Park are in poor playing condition due to excessive play, weather, and erosion. To restore city ball fields to a play-ready condition staff has selected Barkshire Laser Leveling Inc. to bring the necessary amount of clay dust and laser level the surface of the baseball diamonds. Staff recommends the City Council approve the Public Works agreement with Barkshire Laser Level Inc. to perform this task at Dominguez Park and Dolphin Park, for a not-to-exceed amount of $40,000 plus $4,000 contingency. The total amount requested is $44,000.
II. RECOMMENDATION
Recommendation
TAKE the following actions:
1. AWARD and APPROVE the Public Works Agreement with Barkshire Laser Leveling Inc. for laser leveling of the baseball infields at Dominguez Park and Dolphin Park, for a not-to-exceed contract sum of $40,000 (Exhibit No. 1)
2. AUTHORIZE the expenditure of construction contingencies in the amount of $4,000 (10%) for any unforeseen construction work such as substructure conflicts, contaminated soil removal and disposal, material testing, and other work that may be necessary to complete the project.
3. AUTHORIZE the Mayor to execute the Agreement following approval as formed by the City Attorney.

TAKE any other action City Council deems appropriate and consistent with the requirements of applicable law.
IV. BACKGROUND
The City of Carson is responsible for the maintenance of 21 baseball diamonds throughout ten City parks. Through normal use, ruts develop around the bases and uneven areas are caused by extensive play, erosion, and weather events. As part of regular maintenance laser leveling of baseball diamonds is required to ensure a smoother playing surface, increased playability, fewer postponements, and to allow for effective water drainage.
The proposed laser leveling project is subject to the State bidding laws known as the Uniform Public Construction Cost Accounting Act (UPCCAA) adopted by the City as set forth in Section 2612 of its Municipal Code. Under UPCCAA, public projects of $60,000 or less have no bidding requirement attached to it.
In March of 2021, Calas Park and Stevenson Park underwent the very same laser leveling with positive results, with such work having been performed by Barkshire Laser Leveling Inc. For this reason, and because this contractor’s qualifications and background have already been vetted by staff and this contractor has been determined to possess the requisite ability to complete the work, the City Council is now being asked to award a contract to Barkshire Laser Leveling Inc. for an amount not to exceed $40,000.00 in accordance with the quotes provided to City on January 6, 2023 (Exhibit No. 2; Exhibit No. 3). An additional $4,000 is being requested as a contingency for any unforeseen work as is typical with public works contracts, for a total of $44,000. The project is expected to be completed within 45 calendar days from the issuance of a notice to proceed.
V. FISCAL IMPACT
Funds for this project were included in the adopted FY 2022-2023 budget in Account No. 101-80-840-107-6004.
