CONSIDER AWARDING A CONTRACT SERVICES AGREEMENT TO DISABILITY ACCESS CONSULTANTS, A CALIFORNIA LIMITED LIABILITY COMPANY, TO DEVELOP A COMPREHENSIVE ADA SELF-EVALUATION AND TRANSITION PLAN

I. SUMMARY
The Americans with Disabilities Act (ADA) is an all-inclusive law that mandates equal opportunity for individuals with disabilities and guarantees that they have the same opportunities as everyone else to participate in daily life activities. Title II of the ADA requires that state and local governments make all programs, services, buildings, parks, etc. accessible to people with disabilities.
The ADA Self-Evaluation and Transition Plan will review the City’s programs, services, facilities, public-rights-of-way, and activities; with the initial purpose of identifying barriers to accessibility by individuals with disabilities (” Self-Evaluation”). The Transition Plan will assist the city to direct its resources and efforts to increase accessibility in those areas identified in the Self-Evaluation.
Staff is hereby recommending that City Council approve a contract with Disability Access Consultants (“DAC”) to develop the City’s ADA Self-Evaluation and Transition Plan.
II. RECOMMENDATION
Recommendation
Staff recommends that City Council:
1. AWARD a contract to Disability Access Consultants, a California Limited Liability Company, to develop a comprehensive ADA Self-Evaluation and Transition Plan for a total cost of Three Hundred Eighty-Four Thousand Seven Hundred Ninety Dollars ($384,790); and
2. Authorize the Mayor to execute the contract.

IV. BACKGROUND
Title II of the ADA requires that state and local governments make all programs, services, and facilities accessible to people with disabilities. The Self-Evaluation and Transition Plan will identify barriers to accessibility to City programs, services, facilities, public-rights-of-way and activities; by individuals with disabilities; and create a transition plan to assist the City to direct its resources and efforts to increase accessibility.
RFP 22-023 was issued in June 2022 seeking proposals from qualified firms. Two responsive proposals were received. Staff evaluated the proposals, interviewed the proposers, and conducted reference checks. DAC was chosen based on responsiveness to City needs, firm’s resources, technical qualifications, success in similar projects and professional reputation of the firm.
As part of the proposed project, DAC will make their proprietary computer system, DACTrac, available to City staff to monitor progress. DACTrac subscription is included free of charge for one year, thereafter it is available at a cost of $2,000 per year. The proposed contract amount includes 3 additional years of subscription beyond the initial free period.
V. FISCAL IMPACT
Funds for this project are included in the fiscal year 22-23 Risk Management budget in account 101-50-660-172-6004.
