CONSIDERATION TO ACCEPT THE PROJECT AS COMPLETE, PROJECT NO. 1665: 189TH STREET, PEDESTRIAN BRIDGE REPAIR (CITY COUNCIL)

I. SUMMARY
On November 16, 2021, the City Council approved Item No. 14 awarding a Construction Contract to Beador Construction Company, Inc. for $506,700.00 for Project No. 1665: 189th St. Pedestrian Bridge Repair. The expenditure of construction contingencies for $76,005.00 (15%) was also authorized for any unforeseen construction work that may be necessary to complete the project, for a total budget of $582,705.00.
Additional work for $70,011.82 requested by staff during construction was added to the original scope of work, which requires the execution of change order to allow contractor to move forward with the project completion.
Project No. 1665: 189th Street Pedestrian Bridge has been completed in accordance with the approved plans and specifications. It is requested that the City Council accept the work as complete and authorize staff to file the Notice of Completion with the Los Angeles County Registrar-Recorder/County Clerk Office.
II. RECOMMENDATION
Recommendation
TAKE the following actions:
1. ACCEPT as complete Project No. 1665: 189th Street Pedestrian Bridge.
2. AUTHORIZE staff to file a Notice of Completion.

III. ALTERNATIVES
1. DO NOT ACCEPT the project as complete. However, Civil Code section 9204 requires a public entity record a Notice of Completion after work completion, upon the completion and settlement of all public works project claims, if any.
2. TAKE another action the City Council deems appropriate consistent with the requirements of the law.
IV. BACKGROUND
On November 16, 2021, a Construction Contract was awarded to Beador Construction Company, INC. for $506,700.00 for Project No. 1665: 189th St. Pedestrian Bridge (Staff Report No. 2021-874). City Council also authorized the expenditure of construction contingencies for $76,005.00 (15%) for any unforeseen construction work that may be necessary to complete this project, for a total budget of $582,705.00.
This project consisted of removing, replacing, and repairing damaged bridge structure improvements at the 189th Street Pedestrian Bridge. The improvements included: cleaning and painting existing steel girders, removing the existing asphalt deck and replacing it with a metal deck infilled with reinforced concrete, removing the existing fence and replacing it with a new bridge guardrail fence, installing a new solar lighting system, removal and replacement of the asphalt concrete pavement at the approach sidewalks, removal and replacement of approach sidewalk bollards, and the installation of detectable warning tiles.
The project construction started on May 4, 2022 and ended on July 5, 2022. Two change orders amounting to $70,011.82 were executed during the construction phase.
The construction of this project has been completed in a satisfactory manner and the pedestrian bridge is open for public use. Staff is requesting the City Council to accept the project as complete and authorize staff to proceed with the filing of the Notice of Completion.
V. FISCAL IMPACT
The construction contract amount for this project was $506,700.00. The total project cost including expenditures for permit issuance and design consultant fees is $483,346.07. All expenditures were allocated from the following accounts:
• 217-80-820-904-8013 (Fund 217 - Bikeway/Pedestrian Access State Funded)
• 225-80-820-904-8013 (Fund 225 - South Coast Air Quality Management District)
• 254-80-820-904-8013 (Fund 254 - Measure R Bond).
The project’s total expenditure amount is $23,353.93 lower than originally planned.
