CONSIDER APPROVAL OF A PUBLIC WORKS AGREEMENT WITH ND CONSTRUCTION COMPANY, INC. FOR CITYWIDE BUS STOP IMPROVEMENTS  (CITY COUNCIL)

I.                     SUMMARY

The City of Carson provides fixed-route bus service through Long Beach Transit and the Carson Circuit. As part of these services, the City owns and maintains bus stop fixtures such as benches, trash receptacles, and shelters. Due to constant exposure to outdoor elements, these units have visibly aged over time.

In recent years, Public Works and Transportation staff have replaced 26 shelters and benches with newer units. These shelters exhibit a custom perforated rear wall with the logo “CARSON” as part of their unique design. As part of staff’s efforts to upgrade the City’s remaining bus stops, an order for new units is expected to arrive on or around August 1, 2022.

To remove and install new units, staff recommends the City Council authorize a public works agreement with ND Construction Company, Inc. at a contract sum of $535,272. Should the City Council approve the recommendation, the upgrades are expected to be completed by February 1, 2023.

 II.                     RECOMMENDATION

Recommendation

                     TAKE the following actions:

1. APPROVE the proposed Public Works Agreement with ND Construction Company, Inc. at a contract sum of $535,272 (Exhibit No. 1) (“Agreement”); and

2. AUTHORIZE the Mayor to execute the Agreement, following approval as to form by the City Attorney

IV.                     BACKGROUND

The City of Carson provides fixed-route bus service through Long Beach Transit (LBT) and the Carson Circuit. LBT operates Route 1, 2, 4, and 8, whereas City staff operates Route A and B. Additionally, Metro, GTrans, and Torrance Transit operate bus lines throughout parts of the City as well. The City owns and maintains bus stop fixtures such as benches, trash receptacles, and shelters. Due to constant exposure to outdoor elements, these units have visibly aged over time.

In recent years, Public Works and Transportation staff have replaced 26 shelters and benches with newer units. These shelters exhibit a custom perforated rear wall with the logo “CARSON” as part of their unique design. Staff intends to extend these upgrades across the City’s remaining bus stops and replace aged benches, trash receptacles, and shelters.

New units have been ordered through Tolar Manufacturing Company, Inc. Delivery is expected to take place on or around August 1, 2022. In anticipation of the construction related work to follow, staff inquired with Public Works staff to gauge whether the work could be performed in-house. Due to the vast size of the order and its corresponding workload and schedule, it was determined that an Invitation for Bids (“IFB”) would be favorable.

On March 31, 2022, staff issued IFB 22-18 for this work, but received no bids. Per Public Contract Code Section 22038(c), “If no bids are received through the formal or informal procedure, the project may be performed by the employees of the public agency by force account, or negotiated contract without further complying with this article.” Nonetheless, staff requested price quotes from qualified vendors to help ensure the City received competitive pricing.

Staff received price quotes from AP Construction, Inc. and ND Construction Company, Inc. Although both vendors are qualified and experienced, ND Construction Company, Inc. was chosen as the lowest responsive and responsible bidder.

Staff recommends the City Council authorize a public works agreement with ND Construction Company, Inc. at a contract sum of $535,272. Should the City Council approve the recommendation, the upgrades are expected to be completed by February 1, 2023.

V.                     FISCAL IMPACT

None. A total amount of $535,272 was budgeted in the Fiscal Year 2022-2023 budget in Proposition A account nos. 218-90-940-101-6004 in the amount of $200,000, 218-90-940-180-6004 in the amount of $330,000, and Proposition C account no. 219-90-940-180-6004 in the amount of $5,272.
