CONSIDERATION OF A PROFESSIONAL SERVICES AGREEMENT WITH MICHAEL BAKER IINTERNATIONAL, INC. ("MBI") FOR THE DEVELOPMENT OF A STORMWATER IMPLEMENTATION PLAN AND APPROVAL OF RESOLUTION NO. 22-078 “A RESOLUTION OF THE CITY OF CARSON CITY COUNCIL AMENDING THE FISCAL YEAR 2021-22 BUDGET IN THE SPECIAL REVENUE FUND"

I.                     SUMMARY

On December 16, 2021, the Public Works Department released a Request for Proposal (RFP) 21-047 for the development of a Stormwater Facilities Master Plan. This plan will aid the City of Carson in consolidating into one plan municipal stormwater quality compliance; targeted drainage and flood improvements; operations, maintenance, and non-structural program management; and a financial strategy. Furthermore, it will enable the City to make informed decisions on which stormwater-related projects need to be implemented.

The RFP was advertised on Planet Bids on December 16, 2021. On January 4, 2022, five firms attended the pre-proposal meeting, but only two submitted proposals on February 10: 1) Michael Baker International (MBI) and 2) Craftwater Engineering. The bids were opened by the City Clerk on February 10, 2022; both proposals submitted meet the needs of the City and the requirements of the RFP.

The Engineering selection committee reviewed the proposals and scored them using the criteria set forth in the RFP. The two proposals were competitive, and due to the tight scoring, the selection committee decided to interview the proposers separately via remote videoconferencing. The team interviews consisted of pointed and specific questions by the committee to determine and better understand the team capabilities, scope of services offered, and their knowledge of the Los Angeles Regional Water Quality Control Board (LARWQCB). The responses by the proposers during the team interviews were a determining factor for the selection of the winning proposal.

MBI demonstrated a depth of understanding of the project and their team’s qualifications in their proposal (Exhibit No. 1). During the team interview, MBI highlighted their capabilities on how their plan can benefit the City of Carson.

Staff is recommending the approval of a contract with MBI to develop a Stormwater Implementation Plan for a not-to-exceed amount of $1,106,932.00, with services slated to be completed by July 31, 2023. (Exhibit No. 2)

II.                     RECOMMENDATION

Recommendation

                     TAKE the following actions:

1.                     APPROVE a Professional Services Agreement with MBI for the development of a Stormwater Facilities Master Plan for a negotiated fee not to exceed $1,106,932.00.

2.                     AUTHORIZE the Mayor to execute the Professional Services Agreement following approval as to form by the City Attorney.

3.                     WAIVE further reading and ADOPT RESOLUTION NO. 22-078 “A RESOLUTION OF THE CITY OF CARSON CITY COUNCIL AMENDING THE FISCAL YEAR 2021-22 BUDGET IN THE SPECIAL REVENUE FUND” to appropriate $1,106,932 toward the proposed Stormwater Implementation Plan (Exhibit No. 3)

III.                     ALTERNATIVES

1.                     DO NOT APPROVE the Professional Services Agreement.

2.                     TAKE another action the City Council deems appropriate and consistent with the requirements of the law.

IV.                     BACKGROUND

This City of Carson is working on determining the specific stormwater projects to meet all MS4 compliance requirements. To accomplish this goal in a cost-effective manner, the City requested proposals for a comprehensive Stormwater Facilities and Implementation Plan to inform strategic stormwater capital planning, maintenance, designs, construction, and stormwater program management in the City. The plan must consolidate municipal stormwater quality compliance, targeted drainage and flood improvements, operations, maintenance, and non-structural program management, and a financial strategy. This strategy will include government grants, regional programs and partnerships, City funds if required, and the Safe, Clean Water Program into one guiding program. The plan must also provide clear linkages to active/multi-modal transportation and other capital programs and shall be informed by interdepartmental stakeholder input. Three multi-benefit projects prioritized by the Implementation Plan will be advanced to feasibility studies to accelerate progress towards stormwater compliance and community outreach and engagement, and to help secure funding opportunities.

City received two proposals from: 1) Michael Baker International (MBI) and 2) Craftwater Engineering. The bids were opened by the City Clerk on February 10, 2022; both proposals submitted meet the needs of the City and the requirements of the RFP, with MBI’s proposal being for an amount of $1,106,932.00 and Craftwater Engineering’s proposal being for an amount of $1,048,227.00. Under City’s CMC, award of the contract is to be based on demonstrated competence, the professional qualifications necessary for satisfactory performance of the required services, and a fair and reasonable price. CMC Section 2611(c).

The Engineering selection committee reviewed the proposals and scored them using the criteria set forth in the RFP.

As typical in all engineering RFPs, optional tasks were requested and were included in MBI’s proposal. MBI highlighted that for a successful program the following should be included: two additional feasibility studies, stakeholders and community outreach and engagement, and the Private Property Partnership Program (P4).

MBI’s total proposal is $1,106,932 and includes the optional tasks. The optional tasks included community engagement and additional feasibility studies. Both these optional tasks will help in securing grant funds and being more competitive for grants as they both are often required for grants. These optional tasks will help to create a robust and all-encompassing stormwater implementation plan.

The award of this contract to MBI would be the first step in placing Carson on track to meet its stormwater responsibilities to the stormwater and environmental governing bodies, and would continue the City’s progress in providing its constituents much-needed modernization of the City’s stormwater infrastructure.

Staff requests that the City Council approve the Professional Services Agreement with MBI for the development of a Stormwater Facilities Master Plan for a not-to-exceed amount of $1,106,932.

V.                     FISCAL IMPACT

There is no impact to the general fund. Funds in the amount of $1,106,932 were previously allocated in Fund 295 (Measure W) and was assigned to project number 1682 in the 5-year CIP plan. The account no. is 295-80-820-904-6004.
