PUBLIC HEARING TO CONSIDER A SUBSTANTIAL AMENDMENT TO THE 2021-2022 ANNUAL ACTION PLAN (CITY COUNCIL)

I. SUMMARY
Staff is requesting the City Council consider amending the City’s 2021-2022 Annual Action Plan to reallocate previously budgeted Community Development Block Grant (CDBG) funds to meet previously unanticipated needs. This proposed amendment transfers $220,000 from the Anderson Park ADA improvement project to the Neighborhood Pride Program. Due to bidding requirements, the Anderson Park improvements could not be completed in time for Program year (PY) 2021-2022 and as part of the adoption of the draft 2022-2023 Annual Action Plan (another agenda item), the $220,000 is recommended to be allocated again to Anderson Park.
U. S. Department of Housing and Urban Development (HUD) regulations, as well as the City’s Citizen Participation Plan, require that public hearings be held by the City Council regarding proposed Substantial Amendments prior to their submission to HUD.
II. RECOMMENDATION
Recommendation
TAKE the following actions:
1. OPEN the Public Hearing, TAKE public testimony, and CLOSE the Public Hearing.
2. APPROVE the submission of a Substantial Amendment to the 2021-2022 Annual Action Plan to the U. S. Department of Housing and Urban Development.
3. AUTHORIZE the following reallocation of Community Development Block Grant (CDBG) funds within the 2021-2022 Annual Action Plan: From Anderson Park Improvements to Neighborhood Pride Program (Residential Rehabilitation): $220,000.

IV. BACKGROUND
Each year, the City receives from HUD an entitlement amount of CDBG funding based on the City’s overall population, its proportion of low- and moderate-income residents, and other demographic factors. This entitlement amount forms the basis of the City’s Annual Action Plan each year.
Anderson Park Improvements
By means of a Substantial Amendment to the 2020-2021 Annual Action Plan approved by Carson City Council on April 20, 2021, the City of Carson established the Anderson Park Improvements project, a series of physical improvements at Anderson Park (19101 Wilmington Avenue) aimed at improving that park’s compliance with the Americans with Disabilities Act and allocated $220,000 in CDBG funds to that project. Because of the late timing of that Substantial Amendment, the Anderson Park project was carried over into the 2021-2022 program year.
When the City issued an Invitation for Bids for the Anderson Park project, only one contractor submitted a bid. Consequently, since HUD does not accept single bid projects, the project will have to be rebid. With that delay, it is unlikely that the Anderson Park project will be completed in the 2021-2022 program year. Thus, this proposed Substantial Amendment is to reallocate the $220,000 in CDBG funding for the Anderson Park project to the Neighborhood Pride Program. It should be noted that an allocation of $220,000 in CDBG funds for the Anderson Park project has been included in the City’s draft 2022-2023 Annual Action Plan which is on the same agenda.
Neighborhood Pride Program
By means of a Substantial Amendment to the 2021-2022 Annual Action Plan approved by Carson City Council on February 15, 2022, the City of Carson reallocated $95,000 in CDBG funding from the Commercial Loans and Grants Program (Commercial Rehabilitation) to the Neighborhood Pride Program (Residential Rehabilitation), thereby increasing the allocation for the Neighborhood Pride Program from $519,949 to $614,949. Therefore, with the addition of $220,000 as part of this proposed Substantial Amendment, the total allocation budget for Neighborhood Pride Program increases to $834,949.
V. FISCAL IMPACT
No General Fund impact.
Within the Community Development Block Grant Fund:
Account 215-70-720-904-8008 Anderson Park Improvements: decrease of $220,000. Account 215-70-720-964-6062 Neighborhood Pride Program (Residential Rehabilitation): increase of $220,000. Thus, no net impact.
