CONSIDER ADOPTING RESOLUTION NO. 22-022 OF THE CITY OF CARSON, CALIFORNIA MAKING A FINDING OF PUBLIC CONVENIENCE OR NECESSITY FOR AN OFF-SALE PERMIT TO SELL ALCOHOLIC BEVERAGES FOR ALDI MARKET LOCATED AT 20700 S. AVALON BOULEVARD SUITE 103 IN THE SOUTHBAY PAVILION (CITY COUNCIL)

I. SUMMARY
This is a request for approval of a Finding of Public Convenience or Necessity associated with ALDI Market under construction at the SouthBay Pavilion. In November 2021, the California Department of Alcoholic Beverage Control (ABC) informed the Planning Division that a determination of public convenience or necessity would be required to issue an ABC license for the subject property due to an overconcentration of alcohol licenses in the area as well as identification of the area as high crime in accordance with ABC standards. This license (Type 20) would allow ALDI to sell beer and wine in closed containers to be consumed off-site.
Overconcentration is a result of exceeding the allowed number of licenses by ABC in a census tract or the reported crime rates in the census tract exceeds 120% of average number of reported crimes in jurisdiction of the local law enforcement agency. In this case, the number of licenses allowed by ABC in the census tract is four (4) while the number of existing licenses is seven (7). Similarly, the reported crime numbers allowed by ABC in the census tract is 242 while the number of reported crimes in the census tract is 376.
By adopting this resolution, the City Council determines that the benefits of having this grocery store for the community outweighs the risk of approving a license for ALDI in an area that is both experiencing over-concentration of licenses as well as being in an area with higher crime rates than those deemed appropriate by ABC.
