Title

CONSIDER AWARD OF A CONSTRUCTION CONTRACT TO JA URBAN, INC. FOR PROJECT NO. 1656 - COMMUNITY CENTER UPGRADE  (CITY COUNCIL)

I.                     SUMMARY

On May 18, 2021, the City Council approved the plans, specifications and estimates (PS&E) for Project No. 1656: Community Center Upgrade (Exhibit No. 1), and staff was authorized to advertise the project for construction bids. The Community Center Upgrade includes the removal and reconstruction of the restrooms walls and partitions to ensure that all restrooms meet the current Americans with Disabilities Act (ADA) and California Building Code (CBC) standards. The Invitation for Bids (IFB) was advertised in a paper of local circulation and through the PlanetBids portal from July 22, 2021 to August 19, 2021. One bid was received and opened at the City Clerk’s Office. It was determined that JA Urban, Inc. was the lowest responsive and responsible bidder, with a total bid amount of $1,561,857.00

Staff is requesting City Council to award a Construction Contract to JA Urban, Inc for a not-to-exceed amount of $1,561,857.00

 

II.                     RECOMMENDATION

Recommendation

                                          TAKE the following actions:

1.                     AWARD a Construction Contract to JA Urban, Inc., the lowest responsive and responsible bidder, for Project No. 1656: Community Center Upgrade, in the amount of $1,561,857.00.   

2.                     AUTHORIZE the expenditure of construction contingencies in the amount of $234,278.55 (15%) for any unforeseen construction work such as substructure conflicts, contaminated soil removal and disposal, material testing, and other work that may be necessary to complete this project.

3.                     AUTHORIZE the Mayor to execute a Construction Contract with JA Urban, Inc., following approval as to form by the City Attorney.

1.                      REJECT the bid.

2.                     TAKE another action the City Council deems appropriate consistent with the requirements of the law.

IV.                     BACKGROUND

On May 18, 2021, the City Council approved Item No.17, approving the PS&E, and authorizing staff to advertise the work and call for construction bids for Project No. 1656: Community Center Upgrade.

Project No. 1656: Community Center Upgrade is one of the City’s Capital Improvements Program (CIP) projects adopted for FY2021-22. The Community Center Upgrade includes the removal and reconstruction of the restrooms walls and partitions to ensure that all restrooms meet the current American with Disability Act (ADA) and California Building Code (CBC) standards.

The improvements also include the following: (i) aesthetic upgrades to be on par with the existing restrooms north of Halls A, B and C, (ii) improvements to the lighting to utilize LED lighting, (iii) upgrade of the plumbing fixtures, partition walls, mirrors, and floors, (iv) painting and other decorative finishes, (v) adjustment of urinals that are too high, and (vi) removal and replacement of damaged tiles and other related fixtures and items necessary to complete the work.

This project also includes the adjustment of the door located at the main lobby. Currently, this door is sometimes difficult for those with walkers or wheelchairs to utilize the door; by having a push button that opens the door automatically, those individuals will be able to access all points of the facility with less difficulty.

The PS&E for these improvements have been completed by Westberg and White, Inc. The Purchasing Division advertised the Invitation for Bids (IFB 21-14) for the project from July 22 to August 19, 2021; one bid was received through PlanetBids and opened by the Purchasing Division Manager at the City Clerk’s office on August 19, 2021. The bid result is listed below:

Given that there is only one bid received for this project, staff determined that the lowest responsive and responsible bid was submitted by JA Urban, Inc., with a total bid in the amount of $1,561,857.00. JA Urban Inc., is a bonafide contractor licensed by the State of California.  The bid bond, in the amount of 10% of the total bid, as supplied by Harco National Insurance Company, a corporation of the State of Illinois, is in order, and was submitted with the bid.  The project is subject to compliance with the City’s Project Labor Agreement as stated in the bid packet, and the bid amount reflects the same.

The contractor’s references have been checked, and it has been verified that the contractor has completed similar projects in an acceptable manner.  While there was some concern that there was only one bidder, the contractor’s bid was less than the engineer’s estimate and determined to be reasonable.

V.                     FISCAL IMPACT

The construction bid amount for this improvement project is $1,561,857.00 with a construction contingency in the amount of $234,278.55, representing 15% of the total construction bid. The total project cost including the 15% contingency is $1,796,135.55. Funds in the amount of $2,400,000.00 are included in the FY 2021/22 General Fund budget.
