I.                     SUMMARY

On September 7, 2021, under Item No. 45 of Council Agenda, after making specified modifications on the floor, the City Council voted 4/0 to introduce Ordinance No. 21-2118. The ordinance as modified is now being presented for second reading and adoption (Exhibit No.1).

 

II.                     RECOMMENDATION

Recommendation

CONDUCT a Second Reading by title only and with further reading waived, and ADOPT Ordinance No. 21-2118, “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, ADDING CHAPTER 11 (TEMPORARY EVENTS)  TO ARTICLE III (PUBLIC SAFETY) OF THE CARSON MUNICIPAL CODE TO ESTABLISH A REGULATORY PERMIT PROCESS FOR TEMPORARY EVENTS.”

IV.                     BACKGROUND

On September 7, 2021, the City Council introduced Ordinance No. 21-2118 adding Chapter 11 (Temporary Events) To Article III (Public Safety) of the Carson Municipal Code to establish a Regulatory Permit Process for temporary events (City Council).

During consideration of the matter and prior to voting to introduce the ordinance, the Council made two specified modifications to the ordinance, as follows: (1) modify the definition of “City-sponsored events,” which are exempt from the ordinance, to clarify that all City of Carson-budgeted temporary events are “City-sponsored events;” and (2) modify the exemption from the ordinance for  “activities conducted by a governmental agency acting within the scope of its authority,”  to clarify that this category also includes all City of Carson-budgeted events.

The first such modification was made in Section 31102 (“Definitions”) of the proposed municipal code chapter, as follows:

City-sponsored event means a temporary event for which the City Council or City Manager (as applicable) has duly and affirmatively approved City financial support. For the avoidance of doubt, waiver of a City fee does not render a temporary event a “City-sponsored event” for purposes of this definition, but all City of Carson-budgeted temporary events are “City-sponsored events” for purposes of this definition.”

The second such modification was made in Section 31115 (“Exemptions”) of the proposed municipal code chapter, as follows:

“The following events or activities are exempt from the requirements of this chapter:

Activities conducted by a governmental agency acting within the scope of its authority, including all City of Carson-budgeted events.

City-sponsored events.”

Other minor edits were also made to correct errors of a typographical or clerical nature that were inadvertently included in the ordinance as introduced.

The ordinance as modified is now presented to Council for second reading and adoption.V.                     FISCAL IMPACT

None; permit fees will be established by resolution and will offset costs of application processing.
