CONSIDER APPROVAL OF A UTILITY RELOCATION AND REIMBURSEMENT AGREEMENT BETWEEN THE CITY OF CARSON AND METROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA (MWD) FOR THE COSTS OF RELOCATING MWD'S UTILITY EQUIPMENT  (CITY COUNCIL)

I.                     SUMMARY

Project No. 1606 (formerly known as Project No. 1003): 223rd Street Widening and Pavement Rehabilitation from Wilmington Avenue to the East City limit is one of the City’s Capital Improvements Program (CIP) projects adopted for FY2020-21. The project includes pavement rehabilitation, tree removal and replacement, concrete reconstruction (such as curb, gutter and sidewalks), and the widening of a portion of the street starting at 1,500 feet east of the centerline of Wilmington Avenue going east approximately 1,056 feet in length. The project also includes the relocation of MWD’s utility equipment that is located within the Project area and includes a utility vent stack and appurtenant equipment.

 

The purpose of this Agreement is to provide the term and means by which MWD shall reimburse the City of Carson for the relocation of such utility equipment. Staff requests that the City Council approve the Agreement between the City and MWD.

 

II.                     RECOMMENDATION

Recommendation

1.                     APPROVE the Utility Relocation and Reimbursement Agreement between the City of Carson and Metropolitan Water District of Southern California for the costs of relocating MWD's utility equipment.

 

2.                     AUTHORIZE the Mayor to execute the Utility Relocation and Reimbursement Agreement between the City of Carson and Metropolitan Water District of Southern California, following approval by the City Attorney.

IV.                     BACKGROUND

Project No. 1606 - “223rd Street Widening and Pavement Rehabilitation from Wilmington Avenue to the East City limit” included the relocation of all utility equipment in the street widening section of the project. All utility equipment in the City’s Right of Way (ROW) was identified and scoped to be relocated by its respective owners.

MWD’s utility equipment is located within the Project ROW and includes a utility vent stack and appurtenant equipment. This equipment was expected to be relocated by MWD so that the City’s contractor can complete the widening of 223rd Street. However, on May 13, 2021, MWD requested the City to add the relocation of MWD’s vent stack to the contractor’s scope of work, at MWD’s expense. Given the urgency of the project, staff made every effort to accommodate MWD’s request and provided an estimate from All American Asphalt, Inc., the City’s contractor, to perform the relocation.

On August 4, 2021, MWD approved All American Asphalt’s estimate to relocate its equipment for $73,319.31 and submitted a Utility Relocation and Reimbursement Agreement. Staff has reviewed and provided MWD with comments on the agreement. The agreement was also reviewed by the City Attorney and MWD made the corrections as recommended.

Once the Utility Relocation and the Reimbursement Agreement is approved and is fully executed, a change order form will be generated and All-American Asphalt will be directed to commence the work as part of Project No. 1606 - 223rd Street Widening and Pavement Rehabilitation from Wilmington Avenue to the East City limit.

Upon receipt of each invoice from the City and written report showing the breakdown of the invoice amount for the actual work done, MWD will remit the amount owed to the City within thirty days of MWD’s receipt of an invoice.

The contractor will utilize the existing approved traffic control plans and the project schedule will be extended by approximately 5 working days.

Staff requests that the City Council approve the Utility Relocation and Reimbursement Agreement between the City and MWD.

V.                     FISCAL IMPACT

None.  The cost of the labor and material for the relocation of MWD vent stack will be reimbursed by Metropolitan Water District.
