CONSIDERATION TO ACCEPT THE PROJECT AS COMPLETE, PROJECT NO. 1393-2: CITYWIDE ANNUAL OVERLAY PROGRAM AND PROJECT NO. 1411-2: CITYWIDE ANNUAL CONCRETE REPLACEMENT PROGRAM (CITY COUNCIL)

I.                     SUMMARY

On June 2, 2020, a Construction Contract with Hardy & Harper, Inc. for Project No. 1393-2: Citywide Annual Overlay Program, and Project No. 1411-2: Citywide Annual Concrete Replacement Program was amended, at a reduced amount of $830,000.00.

The two projects have been completed in accordance with the approved plans and specifications. It is requested that the City Council accept the work as complete and authorize staff to file the Notice of Completion with the Los Angeles County Registrar-Recorder / County Clerk Office.

II.                     RECOMMENDATION

Recommendation

                     TAKE the following actions:

1.                     ACCEPT as complete Project No. 1393-2: Citywide Annual Overlay Program, and Project No. 1411-2: Citywide Annual Concrete Replacement Program

2.                     AUTHORIZE staff to file a Notice of Completion.

III.                     ALTERNATIVES

1.                      DO NOT ACCEPT the project as complete. However, Civil Code section 9204 requires a public entity record a Notice of Completion after work completion, upon the completion and settlement of all public works project claims, if any.

2.                      TAKE another action the City Council deems appropriate consistent with the requirements of the law.

IV.                     BACKGROUND

On June 2, 2020, the City Council approved Item No. 16 amending and restating a Construction Contract with Hardy & Harper, Inc. for Project No. 1393-2: Citywide Annual Overlay Program, and Project No. 1411-2: Citywide Annual Concrete Replacement Program, for $830,000.00. The expenditure of construction contingences in the amount of $124,500.00 (15%) was also authorized for any unforeseen construction work that may be necessary to complete the project, resulting in a total budget of $954,500.00.

The project improved Sepulveda Boulevard from Figueroa Street to Main Street (Exhibit No. 1). It consisted of grinding existing asphalt pavement surface, removal and reconstruction of deteriorated roadway section, laying-down of asphalt concrete leveling course and asphalt rubberized hot mix (ARHM), as outlined in the City’s most recent Pavement Management Program (PMP). It also consisted of installation of pavement markings, re-striping, bike lane striping, repair of damaged sidewalks, driveway approaches, curbs and gutters, and access ramps. 

These projects were combined to maximize economies of scale while addressing sub-standard elements, maintenance issues, and ADA compliance. They were selected based on the 2017 Pavement Management Program (PMP), the 2017 Sidewalk Assessment Report (SAR), and the allocated budget.

The construction of these projects has been completed in a satisfactory manner and the street is open for public use. Staff is requesting the City Council to accept the project as complete and authorize staff to proceed with the filing of the Notice of Completion.

V.                     FISCAL IMPACT

The construction contract for these improvement projects were $830,000.00. Funds in this amount were included in the FY 2019/20 general fund budget. However, savings realized during construction resulted in the total costs to Hardy & Harper, Inc. of only $534,526.55. The actual expenditures were $395,853.45 under budget and have been earmarked for other high priority streets.
