CONSIDERATION OF RESOLUTION NO. 21-01-CRJPA, A RESOLUTION OF THE CARSON RECLAMATION AUTHORITY REMOVING A CERTAIN MEMBER FROM THE CARSON RECLAMATION AUTHORITY BOARD AND REQUESTING THE CARSON HOUSING AUTHORITY APPOINT A NEW MEMBER

I. SUMMARY
This item was requested to be placed on the agenda by Vice Chairman Cedric Hicks. Section 2.02 of the Bylaws of the Carson Reclamation Joint Powers Authority (“CRA”) states that one appointment to the CRA shall be made by the Chair of the Housing Authority subject to a majority vote of the Housing Authority Board; and, other members appointed by the Housing Authority include members of the Planning Commission and the Environmental Commission, and the Chair of the Economic Development Commission Board or the Housing Authority Secretary. In addition, the Board of Community Facilities Districts 2012-1 and 2012-2 also appoint one at large member. The term for all Officers shall be for five years, but Officers may be removed earlier via a majority vote of the Board. (Section 2.02 of the Bylaws and Section 3.07(b) of the First Amended Joint Powers Agreement of the Carson Reclamation Authority.)
Chair Albert Robles was reappointed to this seat on March 4, 2020, with an expiration date of March, 2025. This resolution would remove Chair Robles from the CRA Board and declare the seat on the CRA Board vacant; and, recommend that the Housing Authority appoint a new member to fill such vacancy.
II. RECOMMENDATION

IV. BACKGROUND
Chair Robles was appointed to the CRA Board in 2015 by the Housing Authority pursuant to Section 2.02 of the Bylaws of the Carson Reclamation Joint Powers Authority and Section 3.07(b) of the First Amended Joint Powers Agreement of the Carson Reclamation Authority, dated March 17, 2015. He was reappointed on March 4, 2020. This seat is an at-large seat and not required to be held by an elected representative.
If the CRA Board does affirm and confirm that Chair Robles is removed from the CRA Board, then it is recommended to declare the seat vacant, and then to request the Housing Authority to appoint a new member, pursuant to Section 2.02 of the Bylaws of the Carson Reclamation Joint Powers Authority and Section 3.07(b) of the First Amended Joint Powers Agreement of the Carson Reclamation Authority, dated March 17, 2015.
Other members over the past five years have been removed from the Board due to their disqualification for Board membership because of being removed from their underlying commission seat (e.g. Planning, Environmental) resulting in a loss of eligibility. Although Chair Robles is qualified to continue serving through March, 2025, Vice Chair is asking for his removal at this time.
