CONSIDER AWARD OF A CONTRACT WITH TAFOYA & ASSOCIATES FOR REPAIR OF THE UNDERGROUND STORAGE TANK LOCATED AT CITY HALL (CITY COUNCIL)

I.                     SUMMARY

Staff is recommending the City Council award a contract to Tafoya & Associates for the repair of the underground storage tank (UST) at City Hall.  A Request for Proposals (RFP No. 20-031), was released on October 1, 2020, to seek proposals from qualified contractors to provide repair services for the UST. Two (2) proposals were received in response to the RFP.

II.                     RECOMMENDATION

Recommendation

                     TAKE the following actions:

1.                     APPROVE the selection of Tafoya & Associates to provide services for repair of the underground storage tank at City Hall in an amount not-to-exceed $39,751.

2.                     AUTHORIZE Mayor to execute a contract with Tafoya & Associates following approval as to form by the City Attorney (Exhibit No.1).

2.                     TAKE another ACTION the City Council deems appropriate and consistent with the requirements of the law.

IV.                     BACKGROUND

On January 24, 2020, the County of Los Angeles Waste Control Engineering Inspector for the Environmental Program Division inspected and tested the City Hall UST. The UST is an underground tank system that has at least 10 percent of its combined volume underground and currently stores approximately four thousand (4,000) gallons of diesel, fueling the stationary backup generator at City Hall. This tank has had issues for a number of years, placing the stationary generator out of service.  The tank annular testing, secondary pipe testing, and pipe sump testing all failed. As a result, the proper course of action was to solicit a contractor to repair of the UST and associated piping. The scope of services primarily includes installation of two (2) new OPM flexworks double wall flexible piping lines, cut-back of existing piping, and removal of existing penetrations inside the piping sump. The full scope of work is shown in Exhibit A of the agreement.

The RFP was open from October 1, 2020 through November 16, 2020 and advertised through PlanetBids and the Daily Journal, and resulted in two proposals (Exhibit No. 2). Staff reviewed and evaluated the proposals based on the criteria outlined in the RFP that included price, experience, and cost of project. It was determined that Tafoya & Associates was the most responsive and responsible bidder with a bid amount of $39,751. Below is a chart of the informal bids:

Since Tafoya & Associates’ services consist of repairing the underground storage tank that is at a City facility, these services are considered public projects under the Public Contract Code and Carson Municipal Code (“CMC”). It should be noted that even though staff opted to utilize an RFP for competitive reasons, Public Contract Code Section 22032(a) of the Uniform Public Construction Cost Accounting Act (adopted by the City under CMC Section 2612) only requires the City to utilize any competitive selection process for public projects of $60,000 or more; this project was $39,751.

V.                     FISCAL IMPACT

Funds required to implement this contract were adopted for the 2020-2021 Fiscal Year Budget and are available for the total not-to-exceed amount of $39,751. Funds will be appropriated from the following account: 101-80-840-6004.
