FIRST READING OF AN ORDINANCE AMENDING SECTION 2404 (PRESENTING MATTERS TO COUNCIL - AGENDAS) OF CHAPTER 4 (CITY OFFICERS - COUNCIL CHAMBERS - MEETINGS) OF THE CARSON MUNICIPAL CODE REGARDING THE MANNER OF PREPARING AGENDAS AND PRESENTING MATTERS TO COUNCIL (CITY COUNCIL)

I.                     SUMMARY

This item is on the agenda at the request of Mayor Albert Robles. He indicated that Mayor-elect Lula Davis-Holmes first requested that the attached proposed ordinance be placed on the agenda for introduction and first reading at the February 5, 2019 City Council meeting. The attached proposed ordinance is substantively the same as what was originally considered at the February 5, 2019, regular City Council meeting.

Carson Municipal Code Section 2404 establishes the procedure for presenting matters to the City Council on the Council meeting agenda. The proposed ordinance amends Section 2404 of the Carson Municipal Code to both allow individual Councilmembers to place items on Council agendas, as well as to provide for reasonable deadlines on such requests absent a bona fide emergency.

Discuss and then consider for INTRODUCTION for first reading by title only and with further reading waived, an Ordinance of the City Council of the City of Carson, California, Amending Section 2404 (Presenting Matters to Council - Agendas) of Chapter 4 (City Offices - Council Chambers - Meetings) of Article II (Administration) of the Carson Municipal Code Regarding the Manner of Preparing Agendas and Presenting Matters to Council.

IV.                     BACKGROUND

This item is back on the agenda at the request of Mayor Albert Robles. He indicated that Mayor-elect Lula Davis-Holmes first requested that the attached proposed ordinance be placed on the February 5, 2019, agenda for introduction and first reading. The attached proposed ordinance is substantively the same as what was considered at the February 5, 2019 City Council meeting.

Mayor-elect Lula Davis-Holmes requested that the attached proposed ordinance be considered by the City Council for introduction and first reading at the February 5, 2019 City Council meeting. The proposed ordinance was continued to the February 7, 2019, meeting. The City Council conducted first reading of the proposed ordinance at the February 7, 2019, meeting; however, there was a request that it be reconsidered at the February 19, 2019 City Council meeting. The motion to reconsider failed. Subsequently, at its March 5, 2019, meeting, the City Council considered whether to place the second reading for this item on a future agenda; however, this motion also failed.

The proposed ordinance amends Section 2404 of the Carson Municipal Code to both allow individual Councilmembers to place items on Council agendas, as well as to provide for reasonable deadlines on such requests absent a bona fide emergency.

Section 2404 of the Carson Municipal Code provides procedures for the placement of agenda items on Council agendas.

On January 8, 2019, the City Council adopted by a second reading Ordinance No. 18-1832 to amend Section 2404 of the Carson Municipal Code. That previous Ordinance No. 18-1832 clarified the procedure for the City Manager’s review of agenda items with the Mayor and the deadline for review and finalization of the City Council meeting agenda. Furthermore, that prior Ordinance No. 18-1832 clarified that, if the City Manager in consultation with the Councilmember or Department Head requesting an agenda item cannot agree on whether to place an item on a future agenda or modify a request, or if the Mayor does not agree to add the item to a future agenda, then the City Manager may add the requested item to the agenda under “Council Member Requests to Add Items to Future Agendas.” The Councilmembers present at the meeting could then, by a 2/3 vote, determine whether to add an item to the agenda for the next regular meeting.

This proposed ordinance before the City Council amends Section 2404 so as to both allow individual Councilmembers to place items on Council agendas, as well as to provide for reasonable deadlines on such requests absent a bona fide emergency.
