CONSIDER AWARD OF A CONSTRUCTION CONTRACT TO ALL AMERICAN ASPHALT, INC. FOR PROJECT NO. 1606: 223RD STREET WIDENING AND PAVEMENT REHABILITATION FROM WILMINGTON AVENUE TO THE EAST CITY LIMIT (CITY COUNCIL)

I. SUMMARY
On August 4, 2020, the City Council approved the plans, specifications and estimates (PS&E) for Project No. 1606: (formerly known as Project No. 1003): 223rd Street Widening and Pavement Rehabilitation from Wilmington Avenue to the East City limit (Exhibit No. 1), and staff was authorized to advertise the project for construction bids. This project includes the improvement of 223rd Street and the widening of portion of 223rd Street to the ultimate right of way.
The Invitation for Bids (IFB) was advertised in a paper of local circulation and through the PlanetBids portal from October 8, 2020 to October 22, 2020. Five bids were received and opened at the City Clerk’s Office. It was determined that All American Asphalt, Inc. was the lowest responsive and responsible bidder, with a total bid amount of $1,671,391.68.
Staff is requesting City Council to award a Construction Contract to All American Asphalt, Inc. for a not-to-exceed amount of $1,671,391.68 (Exhibit No. 2).
II. RECOMMENDATION
Recommendation
TAKE the following actions:
1. AWARD a Construction Contract to All American Asphalt, Inc., the lowest responsive and responsible bidder, for Project No. 1606: 223rd Street Widening and Pavement Rehabilitation from Wilmington Avenue to the East City limit, in the amount of $1,671,391.68.
2. AUTHORIZE the expenditure of construction contingencies in the amount of $250,708.75 (15%) for any unforeseen construction work such as substructure conflicts, contaminated soil removal and disposal, material testing, and other work that may be necessary to complete this project.
3. APPROPRIATE (Allocate) $1,449,304.75 of $1,922,100.43 from RMRA2017SB1 Fund balance to cover the costs of pavement rehabilitation for Project 1606.
4. APPROPRIATE (Allocate) $515,542.61 of $1,922,100.43 from Measure R Highway Program (MRHP) Fund balance to cover the costs of street widening for Project 1606.
5. AUTHORIZE the Mayor to execute a Construction Contract with All American Asphalt, Inc., following approval as to form by the City Attorney.

2. TAKE another action the City Council deems appropriate consistent with the requirements of the law.
IV. BACKGROUND
On August 4, 2020, the City Council approved Item No.11, approving the PS&E, and authorizing staff to advertise the work and call for construction bids for Project No. 1606: 223rd Street Widening and Pavement Rehabilitation from Wilmington Avenue to the East City limit.
Project No. 1606 (formerly known as Project No. 1003): 223rd Street Widening and Pavement Rehabilitation from Wilmington Avenue to the East City limit is one of the City’s Capital Improvements Program (CIP) projects adopted for FY2020-21. This project is listed as the City’s third SB-1 project for FY 2020-21 funded by Road Maintenance Rehabilitation Account (RMRA) funds authorized by the California Transportation Commission (CTC) in the amount of $1,552,527.00. The project will also be partially funded using MRHP funding grant from METRO in the amount of $1,000,000.00 to cover the construction phase of the street widening portion of the project including the removal and replacement of nine streetlight poles.
223rd Street is a major east-west four lane arterial truck route zoned for heavy and light industrial land uses. The length of this corridor is 0.7 miles, and the project includes concrete reconstruction, tree removal and replacement, and reconstruction of failing asphalt roadway section of the street with a Pavement Condition Index (PCI) of 26, as recommended in the Pavement Management Study completed in 2017. The project also includes the widening of the 0.20-mile section of the street starting at 1,500 feet east of centerline of Wilmington Avenue going east approximately 1,056 feet in length along the south side of 223rd Street. This portion of the street widening requires the removal and replacement of nine streetlight poles.
The proposed widening of the street is abutting an unimproved 14-acre parcel along the south side located at 2112 E. 223rd Street, where the street narrows creating a bottleneck condition. The widening area will include the following elements for approximate length of 1,056 lineal feet:
• Construction of new 14-foot wide road pavement section.
• Construction of new 10-foot wide Sidewalk.
• Construction of 1,056 L.F. of 8” Curb & Gutter.
• Construction of PCC improvements (i.e. commercial driveways, access ramps).
• Excavation and reconstruction 5-foot of the existing deteriorated edge of pavement along the new 14-foot paved lane to ensure the integrity of the widening area.
• Traffic stripes, pavement markings.
• Removal of existing 9 streetlight poles by SCE.
• Installation of new 9 streetlights on concrete poles by SCE.
The construction plans for the removal and replacement of streetlight poles have been completed by SCE and an invoice in the amount of $37,171.24 has been paid by the City prior to start of construction. Also, SCE has confirmed receiving the payment of their invoice in the amount of $37,171.24 on October 20, 2020 to move forward with the project.
The PS&E for the street improvements have been completed by Willdan Engineering, Inc. The Purchasing Division advertised (IFB 20-05) the projects for construction bids from October 8, 2020 to October 22, 2020; five bids were received through PlanetBids and opened by the Purchasing Division Manager at the City Clerk’s office on October 22, 2020. Staff reviewed the bids and determined that the lowest responsive and responsible bid was submitted by All American Asphalt, Inc., with a total bid in the amount of $1,671,391.68, All American Asphalt is a bonafide contractor licensed by the State of California. The bid bond, in the amount of 10% of the total bid, as supplied by Fidelity and Deposit Company, a corporation of the State of Maryland, is in order, and was submitted with the bid. The project is subject to compliance with the City’s Project Labor Agreement as stated in the bid packet, and the bid amount reflects same.
The contractor’s references have been checked, and it has been verified that the contractor has completed similar projects in an acceptable manner. It should also be noted that All American Asphalt completed Project No. 1362: Figueroa Street Pavement Reconstruction from the I-405 Freeway to Victoria Street in 2014, and Project No 1330: Avalon Boulevard Pavement Restoration from the I-405 Freeway to 223rd Street in 2015, within the City of Carson, all in a satisfactory manner.

V. FISCAL IMPACT
The construction bid amount for this improvement project is $1,671,391.68 with a construction contingency in the amount of $250,708.75, representing 15% of the total construction bid. The total project cost including the 15% contingency is $1,922,100.43. Funds in this amount are included in the FY 2020/21 Special Revenue budget under the following account numbers
288-80-820-904-8009 and 259-80-820-904-8009.
