CONSIDER AWARD OF A CONSTRUCTION CONTRACT TO ALL AMERICAN ASPHALT, INC. FOR PROJECT NO. 1393-3: CITYWIDE ANNUAL OVERLAY PROGRAM AND PROJECT NO. 1411-3: CITYWIDE ANNUAL CONCRETE REPLACEMENT PROGRAM (CITY COUNCIL)

I.                     SUMMARY

On April 21, 2020, the City Council approved the plans, specifications and estimates (PS&E) for Project No. 1393-3: Citywide Annual Overlay Program, and Project No. 1411-3: Citywide Annual Concrete Replacement Program. These projects include the improvement of Victoria Street from Figueroa to Avalon, and various streets within the adjacent zones (Exhibit No. 1). To maximize economies of scale, these two projects have been combined, with a total cost estimate of $1,500,000.00.

The project was advertised for construction bids and on June 9, 2020, and seven bids were received and opened by the City Clerk. However, at its meeting on August 18, 2020, the City Council approved Agenda Item No. 13 rejecting all bids due to bid irregularities and staff was authorized to re-advertise the project.

The project was re-advertised in a newspaper of local circulation and through the PlanetBids portal from September 24, 2020 to October 15, 2020. Seven bids were received and opened at the City Clerk’s Office. It was determined that All American Asphalt, Inc. was the lowest responsive and responsible bidder, with a total bid amount of $1,440,375.00.

Staff is requesting City Council to award a Construction Contract to All American Asphalt, Inc. for a not-to-exceed amount of $1,440,375.00.

 

 

II.                     RECOMMENDATION

Recommendation

                     TAKE the following actions:

1.                     AWARD a Construction Contract to All American Asphalt, Inc., the lowest responsive and responsible bidder, for Project No. 1393-3: Citywide Annual Overlay Program and Project No. 1411-3: Citywide Annual Concrete Replacement Program, in the amount of $1,440,375.00. 

2.                     AUTHORIZE the expenditure of construction contingencies in the amount of $216,056.25 (15%) for change orders and any unforeseen construction work such as substructure conflicts, contaminated soil removal and disposal, material testing, and other work that may be necessary to complete these projects.

3.                     APPROPRIATE (Allocate) $1,325,145.00 of $1,656,431.25 from Measure R Fund balance to cover the costs of Citywide Annual Overlay Program and 15% contingency for Project 1393-3.

4.                      APPROPRIATE (Allocate) $331,286.25 of $1,656,431.25 from Measure R Fund balance to augment the amount currently budgeted for this project and to cover the 15% contingency necessary for Project 1411-3.

5.                     AUTHORIZE the Mayor to execute a Construction Contract with All American Asphalt, Inc., following approval as to form by the City Attorney.

III.                     ALTERNATIVES

1.                     REJECT all bids.

2.                     TAKE another action the City Council deems appropriate consistent with the requirements of the law.

IV.                     BACKGROUND

At its meeting on April 21, 2020, the City Council approved Agenda Item No.8, approving the PS&E, and authorizing staff to advertise the work and call for construction bids for Project No. 1393-3: Citywide Annual Overlay Program and Project No. 1411-3: Citywide Annual Concrete Replacement Program.

The Annual Overlay Program will improve Victoria Street from Figueroa Street to Avalon Boulevard and other various streets on adjacent zones. It consists of grinding two inches of existing asphalt pavement surface, removal and reconstruction of deteriorated roadway section, laying-down of AC leveling course and asphalt rubberized hot mix (ARHM), installation of pavement markings, re-striping, and other related work.  Victoria Street will have a new bike lane striped spanning from Figueroa Street to Avalon Boulevard.

The Annual Concrete Replacement Program will improve the conditions of various types of concrete along Victoria Street from Figueroa Street to Tamcliff Avenue. The project consists of repair of damaged concrete pavement, sidewalks, driveway approaches, curbs and gutters, access curb ramps, and tree removals, restoration of concrete improvements to City standard, and compliance with Americans with Disabilities Act (ADA) requirements.

These projects are combined to maximize economies of scale while addressing sub-standard elements, maintenance issues, and ADA compliance. The locations were selected based on the 2017 Pavement Management Program (PMP), the 2017 Sidewalk Assessment Report (SAR), and the allocated budget.

The project was advertised for construction bids and on June 9, 2020, seven bids were received. After the bid opening, a protest was filed by one of the bidders due to some bid irregularities. After consulting with the City Attorney, it was recommended that the project be re-advertised following City Council’s authorization.

At its meeting on August 18, 2020, the City Council approved Agenda Item No. 13 rejecting all bids, and authorized staff to re-advertise the project for construction bids. The Invitation for Bids (IFB) was advertised in a newspaper of local circulation and through the PlanetBids portal from September 24, 2020 to October 15, 2020. Seven bids were received and opened at the City Clerk’s Office.

Staff reviewed the bids and determined that the lowest responsive and responsible bid was submitted by All American Asphalt, Inc., with a total bid in the amount of $1,440,375.00, All American Asphalt is a bonafide contractor licensed by the State of California.  The bid bond, in the amount of 10% of the total bid, as supplied by Fidelity and Deposit Company, a corporation of the State of Maryland, is in order, and was submitted with the bid.  The project is subject to compliance with the City’s Project Labor Agreement as stated in the bid packet, and the bid amount reflects same.

The contractor’s references have been checked and it has been verified that the contractor has completed similar projects in an acceptable manner. It should also be noted that All American Asphalt completed Project No. 1362: Figueroa Street Pavement Reconstruction from the I-405 Freeway to Victoria Street in 2014, and Project No 1330: Avalon Boulevard Pavement Restoration from the I-405 Freeway to 223rd Street in 2015, within the City of Carson, all in a satisfactory manner.

V.                     FISCAL IMPACT

The construction bid amount for this improvement project is $1,440,375.00 with a construction contingency in the amount of $216,056.25, representing 15% of the total construction bid. The total project cost including the 15% contingency is $1,656,431.25. Funds in this amount are included in the FY 2020/21 Special Revenue budget under the following accounts 254-80-820-904-8009 and 281-80-820-904-8009.
