CONSIDER APPROVAL OF SETTLEMENT AGREEMENT IN THE MATTER OF MARIA DE LOURDES PEREZ V. CITY OF CARSON, ET AL. (LASC CASE NUMBER 19STCV05819) (CITY COUNCIL)

I. SUMMARY
This report concerns settlement of the litigation in the matter of Maria De Lourdes Perez v. City of Carson, et al. (LASC Case Number 19STCV05819). The plaintiff alleged various knee and ankle injuries resulting from a trip and fall on a raised tree stump in the parkway adjacent to the sidewalk located at 2625 E. Carson Street. The matter was settled on January 24, 2020. The fiscal impact to the City is $35,000. Staff recommends that the City Council approve the settlement and authorize the City Manager to execute the settlement agreement, and any related documents, to resolve the litigation.
II. RECOMMENDATION

1. Approve the settlements.
2. Authorize the City Manager to execute the settlement agreements, and any related documents, to resolve the litigation.

IV. BACKGROUND
Plaintiff Maria De Lourdes Perez ("Plaintiff") alleges that on April 11, 2018, she tripped and fell on a tree stump that was hidden in a thick patch of grass while walking on the parkway adjacent to the sidewalk located at 2625 E. Carson Street.
The matter was settled via negotiation with Plaintiff's counsel on January 24, 2020. The fiscal impact to the City is $35,000. Staff recommends that the City Council approve the settlement and authorize the City Manager to execute the settlement agreement, and any related documents, to resolve the litigation.
