CONSIDER APPROVAL OF AMENDMENT NO. 2 WITH CNC ENGINEERING TO EXTEND THE TERM OF ITS CONTRACT TO ALIGN WITH THE UPDATED CONSTRUCTION SCHEDULE FOR PROJ. NO. 1422: BROADWAY INTERSECTION IMPROVEMENTS-TRAFFIC SIGNAL MODIFICATIONS (CITY COUNCIL)

I. SUMMARY
On February 4, 2020, the City Council approved the Plans, Specifications, and Estimates (PS&Es) for Project No. 1422: Broadway Intersection Improvements - Traffic Signal Modifications and authorized staff to advertise the work. The City Council also authorized the City Manager to sign the amended funding agreement with Los Angeles County Metropolitan Transportation Authority (LACMTA), which provides reimbursable grant funds in the amount of $528,638 for this project.
In addition to the prior approvals, staff is requesting the City Council approve a contract amendment with CNC Engineering (CNC), the firm that was selected to prepare the PS&Es for this project. The term of the contract needs to be extended to align with the updated construction schedule.
Staff worked with the City Attorney’s office to prepare Amendment No. 2 to extend the term of CNC’s contract through February 28, 2021. (Exhibit No. 1).
II. RECOMMENDATION
Recommendation
AUTHORIZE the Mayor to execute contract Amendment No. 2 with CNC Engineering, Inc. after approval as to form by the City Attorney.

2. TAKE another action the City Council deems appropriate consistent with the requirements of the law.
IV. BACKGROUND
The City’s Capital Improvement Program (CIP) calls for the construction of Project No. 1422: Broadway Intersection Improvements - Traffic Signal Modifications.
The PS&E’s were prepared by CNC and the term of its contract expired on December 31, 2019. The contract needs to be extended to align with the updated construction schedule. A balance of $18,696.96 remains on the existing contract plus design contingency funds in the amount of $5,032.00. As part of the original scope of work, CNC is required to provide construction support, review contractor submittals, and provide customized foundation designs should underground utilities be found that prevent the placement of typical traffic signal foundations. A time extension is necessary to allow CNC to perform the remaining scope of work stipulated in the contract. The revised term of the contract will extend through February 28, 2021 and no additional compensation will be added to the original contract amount.

V. FISCAL IMPACT
There will be no impact on the city’s existing budget. Amendment No. 2 only extends the term of the contract through February 28, 2021 and no additional compensation will be added to the original contract amount. CNC has a balance of $18,696.96 remaining on its contract plus design contingency funds of $5,032.00.
