DISCUSS AND CONSIDER THE REGULATIONS REGARDING FOOD TRUCKS (CITY COUNCIL)

Body
I. SUMMARY

At the request of Councilman Hilton, this item has been scheduled for City Council's consideration. Ordinance 12-1491 regulates operation of food trucks or mobile food vendors (Vendors) in the public right of way. CMC does not regulate Vendors on private properties but these maybe regulated by the property owners. The regulations apply to time, place and manner of vending from vehicles along streets in order to promote public safety. As long as Vendors comply with these standards, the City issues a permit and the Vendors are allowed to operate. In addition, CMC includes standards and conditions for Food Truck Events, which are events with multiple vendors in a specific location and time.

The following provides some of the standards for Vendors:

1. Not permitted within City parks, unless associated with a City event;
2. Not permitted within 1,500 feet of any public or private elementary or secondary school between the hours of 6:30 a.m. and 5:30 p.m. on any day when such school is in session;
3. Not permitted within 25 feet of any street intersection controlled by a crosswalk, traffic light, or stop sign;
4. Hours of operation between 7:00 a.m. and 10:00 p.m.;
5. Required compliance with all parking provisions;
6. No obstruction of pedestrian or vehicular traffic;
7. No encroachment onto a public sidewalk; and
8. Provide litter and recycling receptacles in the immediate vicinity.
If the City Council directs staff to make modifications to the standards, staff would have to bring back a future agenda item for City Council's consideration.


II. RECOMMENDATION
Recommendation

TAKE the following actions:
1. CONSIDER the mobile food vendor standards and conditions; and
2. PROVIDE direction to staff.
