CONSIDER A RECOMMENDATION BY THE ENVIRONMENTAL COMMISSION TO MODIFY OR END THE CITY'S SAFE AND SANE FIREWORKS PROGRAM (CITY COUNCIL)

I. SUMMARY

On May 1, 2019, the Environmental Commission approved a measure with an 8-0 vote to request the City Council to modify or end the City's safe and sane fireworks program regulated by Carson Municipal Code Section 3101 (Exhibit No. 1). The Commission's letter to the City Council referenced the following reasons for its recommendation: safety and fire danger, health, illegal fireworks, noise disturbance, and improper disposal (Exhibit No. 2). Staff requests direction from the City Council regarding this request. If the City Council directs staff to make modifications or end the program, staff would have to bring back a future agenda item for City Council's consideration.


II. RECOMMENDATION
Recommendation

TAKE the following actions:
1. CONSIDER the Environmental Commission's recommendation; and
2. PROVIDE direction to staff.

TAKE such other action as the City Council deems appropriate consistent with the requirements of law.


IV. BACKGROUND

The City currently has two permitted fireworks wholesalers who sell fireworks to non-profit organizations (Exhibit No. 3). In 2019, these wholesalers rented 16 fireworks stands to organizations to conduct retail sales of fireworks. In 2019, the City generated $25,265 from business licenses and permits from these wholesalers, which is the only source of revenue for the City from this Program. In 2018 (2019 revenue numbers are not available), seventeen (17) fireworks stands generated $601,027 in gross sales generating $231,382 in profits for their organizations use. The City does not receive revenue from the organizations that sell fireworks.


V. FISCAL IMPACT

There is no fiscal impact in providing this report to the City Council.
