CONSIDERATION TO ACCEPT AS COMPLETE PROJECT NO. 1363: DOMINGUEZ CHANNEL TRASH REDUCTION PROJECT  (CITY COUNCIL)

I.                     SUMMARY

Project No. 1363:  Dominguez Channel Trash Reduction Project has been completed in accordance with approved plans, specifications, and estimates (PS&E). It is requested that the City of Carson (City) accept the work as complete and authorize staff to file the Notice of Completion with the Los Angeles County Registrar-Recorder / County Clerk Office.

II.                     RECOMMENDATION

Recommendation

                     TAKE the following actions:

1.                     ACCEPT as complete Project No. 1363:  Dominguez Channel Trash Reduction Project.

2.                      AUTHORIZE staff to file a Notice of Completion.

1.                     DO NOT ACCEPT the project as complete.  However, Civil Code section 9204 requires a public entity record a Notice of Completion after completion of work, upon the completion and settlement of all public works project claims, if any.

 

2.                     TAKE another action the City Council deems appropriate, consistent with the requirements of the law.

IV.                     BACKGROUND

The City’s Capital Improvement Program (CIP) called for the construction of Project No.  1363:  Dominguez Channel Trash Reduction Project Phase II (Exhibit No.  1). The project consisted of the installation of Automatic Retractable Screen (ARS) and/or Connector Pipe Screen (CPS) units on more than 1,000 catch basins within the City of Carson that drain to the Dominguez Channel Estuary.

On May 5, 2015 the City Council approved Item No. 10 accepting the award of Proposition 84 Round 2 Integrated Regional Water Management (IRWM) implementation grant in the amount of $1,500,000.00 from the California Department of Water Resources (DWR).  The grant was administered by the Los Angeles County Flood Control District (LACFCD), who took responsibility for submitting the documentation required under the grant agreement to DWR on behalf of the City. LACFCD received 2.5% of the grant amount for administration and oversight of the grant, resulting in a net grant amount of $1,462,500.00 to the City. These grant funds were to provide financial assistance for the installation of a Full Capture System in the Dominguez Channel Watershed and the associated project construction will be reimbursed to the City.

The City of Carson was responsible for the construction and installation of the ARS and CPS units, project monitoring and management, operations and maintenance, and legal compliance with the requirements of the DWR. On February 2, 2016, City Council approved Item No. 18 approving the PS&E for Project No.  1363: Dominguez Channel Trash Reduction Phase II; and authorizing staff to advertise the work and call for construction.  On April 5, 2016, City Council approved Item No. 17 awarding a construction contract to United Storm in the amount of $1,472,852.73 for Project No.  1363: Dominguez Channel Trash Reduction Phase II.

The Dominguez Channel Trash Reduction Project was initially aimed to prevent approximately 37.7 tons of trash, vegetation, and debris from entering the Dominguez Channel and Estuary by installing automatic retractable screens and/or connector pipe screens on approximately 1,800 catch basins that drain to the Dominguez Channel.

During the planning, design and engineering of the proposed project, it was determined by the Los Angeles Flood Control that only 21.50 tons were feasible to be captured annually due to the configuration of some of the catch basins that ultimately did not allow for the installation of ARS/CPS. As a result, the project installed ARS/CPS units on 1,027 catch basins, leaving the balance of the 1,800 catch basins without ARS/CPS units.  The maintenance of the ARS/CPS units that were installed will be the responsibility of the City. Catch basins without ARS/CPS will be maintained by the LACFCD per a General Services Agreement between the City and LACFCD.

The installation of the ARS/CPS has been completed in a satisfactory manner and the units are now functioning efficiently. Staff is requesting the City Council accept the project as complete and authorize staff to proceed with filing the Notice of Completion. Following the acceptance of the project, staff will submit the deliverables to the LACFCD to be forwarded to the IRWM in order to comply with the grant reporting requirements.

V.                     FISCAL IMPACT

The total initial estimated cost for this project was $1,932,500.00. The City of Carson was awarded a grant of $ 1,500,000.00. Per the grant agreement with the IRWM, the City’s local match was $470,000.00, which included in kind services such as permitting, environmental documentation, engineering, and construction oversight. The grant administrator (LACFCD) received 2.5 percent of the total grant amount for administrative oversight. The net grant amount to the City was $1,462,500.

Funds for the construction of this project were included in the FY 2015/16 budget.  The City’s local match of $470,000 was appropriated and assigned to account no. 01-99-999-0048050/0136301- Dominguez Channel Trash Reduction Phase II. The actual expenditure of $1,347,322.66 is less than the amount budgeted. The remaining net grant balance of $115,177.34 was re-allocated to other agencies by the IRWM.
