CONSIDER ADOPTION OF RESOLUTION NO. 19-050 AND AWARD CONTRACT TO MICON CONSTRUCTION INC., FOR PROJECT NO. 1550 DOLPHIN PARK ADA-COMPLIANT PLAYGROUND AREA FOR CHILDREN OF DIFFERING ABILITIES (CITY COUNCIL)

I.                     SUMMARY

In September 2018, engineering staff issued a Request for Proposals (RFP) to interested companies to design and build an ADA-compliant playground structure for children ages 2 to 12 with varying types of abilities for Project No. 1550 Dolphin Park ADA-Compliant Playground Area for children of differing abilities. The RFP was for the preparation of construction plans, specifications and estimates (PS&E) and construction of the project.

The two firms that submitted proposal packages were placed on the ranking list. The top ranked and most responsive and responsible firm is Micon Construction, Inc. Therefore, staff recommends the award of a design-build contract to Micon Construction, Inc. in the amount of $1,073,394.00. 

 

II.                     RECOMMENDATION

Recommendation

                     TAKE the following actions:

1.                     AWARD a contract (in substantially the form attached as Exhibit No. 5, with the finalized contract being subject to the approval of the City Manager and City Attorney) to Micon Construction, Inc. for the preparation of construction plans, specifications and estimates, and construction of Project No. 1550: Dolphin Park ADA-Compliant Playground Area for children of differing abilities in the amount of $1,073,394.00

2.                     AUTHORIZE the expenditure of construction contingencies in the amount of $176,606.00 (approximately 14%) for any unforeseen construction work that may be required to complete this project.

3.                     WAIVE further reading and ADOPT Resolution No. 19-050, “A RESOLUTION OF THE CITY OF CARSON CITY COUNCIL AMENDING THE FY 2018/19 BUDGET IN THE CITY’S GENERAL FUND TO APPROPRIATE FUNDS FOR DOLPHIN PARK ADA-COMPLIANT PLAYGROUND AREA FOR CHILDREN OF DIFFERING ABILITIES PROJECT,” appropriating $750,000.00 from the Restricted Donations Account No. 202-99-999-999-4999, $250,000.00 from Account No. 02-00999000-4999-23143-0 and $250,000.00 from the unreserved City General Fund Reserve Account No. 101-99-999-999-3601 to fund Project No. 1550 Dolphin Park ADA-Complaint Playground Area for children of differing abilities.

1.                     DO NOT APPROVE the award of contract to Micon Construction, Inc.

2.                     TAKE another action the City Council deems appropriate consistent with the requirements of the law.

 

IV.                     BACKGROUND

Dolphin Park is an existing 12-acre facility, located at 21205 S. Water Street, with two lighted ball diamonds, two multi-purpose rooms, an outdoor fitness course, an existing playground area (approximately 9500 sq. ft.), two lighted tennis courts, one multi-purpose game court, a picnic area, a snack bar, and a parking lot (Exhibit No. 1).  A grant from Tesoro was given to the City to improve the existing facility by constructing a new play area which provides equal opportunities for children ages 2 to 12 with varying abilities. The improvements also include installation of drinking water fountains, new canopy or shading features, and upgrading the park restroom and walkways in compliance with the Americans with Disabilities Act (ADA) requirements. With all members of its community in mind, the City intends that the Dolphin Park project design will be accessible to children of differing abilities.

The project’s RFP was advertised via Planet Bids, and two bid packages were received for consideration. Staff reviewed the submitted packages and determined that the most qualified proposer was Micon Construction, Inc. Micon Construction is a bona fide contractor licensed by the State of California. They are experienced providing design and construction of playground equipment throughout Southern California.  They have provided photos of previous projects for different municipalities within the vicinity and have provided supplemental information to ensure that they will deliver a product that the City of Carson will be proud to present to the community (Exhibit No. 2). The contractor’s references have been checked and it has been verified that the contractor has completed similar projects in an acceptable manner. 

Upon award of the design-build contract to Micon Construction, Inc., as indicated in the RFP documents, Micon shall provide three concept renderings and subsequent site layout plans to be considered. The City of Carson will hold a meeting with the community to review and vote on the three concept renderings and site plans. The winning concept, as determined at the community meeting, will be submitted to the City Council for review and approval before proceeding with the completion of the construction documents.

Based on discussions between city staff and Micon Construction, there are two critical path items for this project. The first critical path item is the final approval of the park design and layout concept, only after which Micon and their team can put together the construction documents. The critical date for Micon to receive a finalized and approved design concept and site layout is May 1, 2019. The second critical date is the date by which the contractor places an order for the playground equipment and shade structures with the vendors; that date is June 1, 2019. Vendors for this type of equipment and structures typically experience high demand during the summer months. Should the contractor place the order for these features after June 1, 2019, this project would be competing with similar projects which may result in longer lead times and possible delays.

Critical Path Phase 1: Finalize Design Concept to start construction documents (drawings, detailed cost estimates, and construction schedule)

Critical Date: May 1, 2019

Phase 2 - Construction

10 Months July 2019 through March 2020

Critical Path Phase 2: Procure Playground equipment and shade structures

Critical date: Place order for playground equipment and shade structures by June 1, 2019.

Completion of Construction & Punch list walk

March 2020

 

V.                     FISCAL IMPACT

The negotiated fee for Project No. 1550 is $1,073,394.00. Funding in the amount of $1,250,000.00 is provided through a dedicated grant from the Tesoro Corporation in the City’s Restricted Donations Account No. 202-99-999-999-4999 and Account No. 02-00999000-4999-23143-0 (Exhibit No. 3). To date Tesoro Corporation has donated for payment of $250,000.00 for a total of $1,000,000.00. Based on previous conversations between the City and Tesoro, the remaining $250,000.00 grant funds will be issued to the City prior to the completion of construction. An allocation of $250,000.00 from an unreserved City’s General Fund should be appropriated to cover the remaining construction cost pending the remaining funding from Tesoro (Exhibit No. 4) and then replenished when the grant is received.
