DISCUSSION OF BLANKET PROJECT LABOR AGREEMENT FOR CITY PROJECTS  (CITY COUNCIL)

I.                     SUMMARY

On March 5, 2019, this matter was requested to be placed on tonight’s agenda.

The City’s Project Labor Agreement was a five-year agreement that expired in December 2018. The City Charter, recently adopted by voters in November 2018, changed the City from a general law city to a charter city. Section 915 of  the newly adopted City Charter provides a legal policy on the use of project labor agreements and specifically a $500,000 threshold defining when a project labor agreement is necessary.

On March 5, 2019, Councilmember Dear requested this matter be placed on the agenda to discuss the possibility of extending the language related to contracting operations and/or services to a third party contractor to apply to all city projects including those below the $500,000 policy set in the City Charter. Tonight the City Council is asked to discuss this matter and make a recommendation.

IV.                     BACKGROUND

As it relates to outsourcing, Section 915 of the City Charter, states that, “… in order to promote the efficient administration and completion of City construction projects, the City shall make all best efforts to negotiate a City-wide project labor agreement with the Los Angeles/Orange County Building and Construction Trades Council to cover all City construction projects where the cost to the City is five hundred thousand dollars ($500,000) or more.” The City’s expired project labor agreement and Section 915 of the City Charter is included as Exhibit Nos. 1 and 2.
