CONSIDER APPROVAL OF RESOLUTION NO. 18-076 AND THE USE AND MAINTENANCE AGREEMENT BETWEEN THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT AND THE CITY OF CARSON FOR THE CONSTRUCTION OF PROJECT NO. 1515: CARSON STORMWATER CAPTURE FACILITY AT CARRIAGE CREST PARK (CITY COUNCIL)

I. SUMMARY
The Los Angeles Regional Water Quality Control Board (Regional Board) is encouraging cities to capture and reuse stormwater as a way to address surface water quality issues, as well as to provide new supplies of reclaimed water for irrigation and enhance ground water supplies. The City of Carson (City) was able to secure $13,000,000.00 from CalTrans to fund Project No. 1515: Carson Stormwater Capture Facility at Carriage Crest Park (Project) located at the corner of Sepulveda Blvd. and Figueroa Street (Exhibit No. 1). The Los Angeles County Flood Control District (LA County) will be contributing $5,720,000.00 towards the implementation of this project.
The plans, specifications, and estimates for the project have been completed. Included in the design is the proposed connection of the storm drain line to the existing flood protection facility owned and operated by the Los Angeles County Flood Control District. LA County has provided a Use and Maintenance Agreement for the City’s approval. The Agreement will authorize and permit the City to use a portion of the LA County flood protection facility for the implementation of the Carson Stormwater Capture Facility project. It is staff’s recommendation to approve the Use and Maintenance Agreement in order to move forward with the implementation of Project 1515.
II. RECOMMENDATION
Recommendation
1. APPROVE the Use and Maintenance Agreement between the Los Angeles County Flood Control District and the City of Carson for the construction of Project No. 1515: Carson Stormwater Capture Facility at Carriage Crest Park.
2. AUTHORIZE the Mayor to execute the Use and Maintenance Agreement following approval as to form by the City Attorney.
WAIVE further reading and ADOPT Resolution No. 18-076, “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, AUTHORIZING AMENDING THE FISCAL YEAR 2018-19 BUDJECT IN THE NPDES FUND FOR THE CONSTRUCTION OF PROJECT NO. 1515: CARSON STORMWATER CAPTURE FACILITY AT CARRIAGE CREST PARK”

IV. BACKGROUND
The City is regulated under a stormwater permit issued by the Regional Board, and is participating with LA County and a number of cities in the implementation of the Enhanced Watershed Management Plan (EWMP). The City Council has previously been advised of the $235 million cost estimate to implement the permit over the next twenty years, and has directed staff to seek external funds to implement the program.
The City has secured $13 million grant from the CalTrans Cooperative Implementation Agreement to fund the Carson Stormwater Capture Facility at Carriage Crest Park. This grant does not require any local matching funds and all expenses incurred by the City will be reimbursed by Caltrans.
LA County reached out to the City and expressed an interest in joining the Carson Stormwater Capture Facility at Carriage Crest Park project. On January 9, 2018, the City Council approved a Memorandum of Understanding (MOU) between LA County and the City in order to establish each party’s responsibilities associated with the project. This MOU included the County’s provision of funding not-to-exceed $5,720,000.00 to cover the cost of planning, engineering, design, and construction associated with upsizing of the project. This upsizing will result in the capture of the 85th percentile, 24-hour storm event runoff volume from the County’s land area tributary.
On July 19, 2016, the City Council approved a Professional Services Agreement with the Sanitation District for the design, and construction management of the project. The plans, specifications, and estimates (PS&E) have been completed and on April 17, 2018 a construction contract was awarded to the lowest responsive and responsible bidder, OHL USA, Inc. in the amount of $11,198,500.00. The City Council also authorized the expenditure of a construction contingency, in the amount of $1,679,775.00 (15%) for any unforeseen construction work, such as the removal and remediation of contaminated soil, substructure conflicts, and any soil and material testing required to complete this project.
This project will greatly assist the City and the County in complying with the applicable Total Maximum Daily Load (TMDL) by minimizing the chance of transport of pollutants downstream to Machado Lake, and facilitating compliance with the EWMP requirements for a large portion of the community. The fabrication of the precast modular watertight storage system is in process, and the timeline for delivery to the construction site will be determined soon.
The project will capture stormwater in an off-line cistern below a renovated ball field in Carriage Crest Park. The water will then be treated for irrigation use at the park, or be transferred to the nearby Joint Water Pollution Control Plant (JWPCP) operated by the County Sanitation District for reclamation. This will assist the City in protecting surface water quality, as well as providing new supplies of reclaimed water for irrigation, and to enhance ground water supplies.
The diversion of stormwater from the proposed facility at Carriage Crest Park to the JWPCP, would require a drop inlet connection to the flood control facility located at the intersection of Figueroa Street and Sepulveda Boulevard which is owned and operated by LA County Flood Control District. A Use and Maintenance Agreement which identifies the City’s responsibility has been provided to the City for approval. The Agreement would authorize the City to use a portion of the County’s facility for the construction, operation, maintenance and repair of the drop inlet connection to the storm drain line. Upon completion of the drop inlet connection, the City will be responsible for the operation and maintenance of the diversion in the County’s facility in a safe, clean, and orderly condition, and in compliance with the Federal and State Laws and local ordinance including the Los Angeles County Flood Control District Code.
Staff requests that the City Council approve the Use and Maintenance Agreement between the Los Angeles County Flood Control District and the City of Carson for the construction of Project No. 1515: Carson Stormwater Capture Facility at Carriage Crest Park (Exhibit No. 2).
V. FISCAL IMPACT
There is no net fiscal impact associated with the recommendation; however the $5.7 million County contribution will need to be appropriated for expenditure to pay the contractors. The attached budget amendment recognizes the $5.7 million of revenue and $5.7 million of expenditures.
The ongoing cost to maintain the new storm drain facility should be added to future operating budgets, but has not been quantified at this time.
