CONSIDER AN AWARD OF A CONSTRUCTION CONTRACT TO R.J. NOBLE COMPANY FOR DEL AMO BOULEVARD REHABILITATION FROM AVALON BOULEVARD TO CENTRAL AVENUE, PROJECT NOS. [1411 & 1393] AND FOR THE FIRST CITY PROJECT FUNDED BY SB1, PROJECT NO. 1547: TURMONT STREET REHABILITATION FROM AVALON BOULEVARD TO CENTRAL AVENUE (CITY COUNCIL)

I. SUMMARY
On December 5, 2017, the City Council approved the plans, specifications and estimates (PS&E) for the first City project funded by Senate Bill 1 (SB1), Project No. 1547: Turmont Street Rehabilitation from Avalon Boulevard to Central Avenue (Exhibit Nos. 1 and 2). To achieve SB1’s requirement of sustaining the Maintenance of Effort (MOE), and to maximize economies of scale, and in consideration of the recently completed Pavement Management Study and the Sidewalk Assessment, the project area was expanded to include Project Nos. [1411 & 1393]: Del Amo Boulevard Rehabilitation from Avalon Boulevard to Central Avenue (Exhibit Nos. 3 and 4).
The Invitation for Bids (IFB) was advertised through the Our Weekly publication and the PlanetBids portal from January 25, 2018 to February 22, 2018. Six bids were received and it was determined that R.J. Noble Company was the lowest responsive and responsible bidder, with a total bid amount of $1,426,509.80
.
II. RECOMMENDATION
Recommendation
TAKE the following actions:
1. AWARD a Construction Contract for Project No. 1547: Turmont Street Rehabilitation from Avalon Boulevard to Central Avenue for FY 2017/18, in the amount of $533,755.00, and Project Nos. [1411 & 1393]: Del Amo Boulevard Rehabilitation from Avalon Boulevard to Central Avenue, in the amount of $892,754.80 to the lowest responsive and responsible bidder, R.J. Noble Company.
2. AUTHORIZE the expenditure of construction contingencies in the amount of $187,490.20 (13.15%) for any unforeseen construction work such as substructure conflicts, contaminated soil removal and disposal, material testing, and other work that may be necessary to complete this project.
3. AUTHORIZE the Mayor to execute the Construction Contract following approval as to form by the City Attorney.

1. REJECT all bids.
2. TAKE another action that the City Council deems appropriate consistent with the requirements of the law.
IV. BACKGROUND
On September 19, 2017, the City Council adopted Item No. 15; Resolution No. 17-131 amending the City’s budget to include Project No. 1547 - Turmont Street Rehabilitation as the first project to be addressed with Senate Bill 1 (SB1) funding.
On October 3, 2017, the City Council approved Resolution No. 17-131(Exhibit No. 5) and approved Item No. 15; the proposed project list for SB1 “Road Repair and Accountability Act of 2017”; amended the FY 2017/18 Capital Improvement Program (CIP) budget to include the proposed ten-year project list for the “Road Maintenance and Rehabilitation Account” (RMRA) funding, and authorized staff to proceed with the SB1 funding application for FY 2017/18.
On October 16, 2017, staff submitted the SB1 Funding Application for Project No. 1547 to the California Transportation Commission (CTC). On November 1, 2017, the California State Controller (CSC) began making SB1 deposits into the newly created RMRA fund. A percentage of this new RMRA funding was apportioned by formula to eligible cities and counties pursuant to State Highway Code Section 2032(h) for basic road maintenance and rehabilitation.
At its December 6 - 7, 2017 meetings, the CSC adopted the list of eligible cities and counties that submitted a project list, as described in the State Highway Code, and are subsequently eligible to receive an apportionment of RMRA funds for the applicable fiscal year. The CSC began apportionment in mid-January 2018, through Resolution G-17-37, Reference No. 4.9.
Based on information received from the California Local Government Finance Almanac, the City of Carson is projected to receive $1.614 million annually for the ten-year life of the SB1 program. Also, the City received an updated partial funding projection on January 11, 2018 in the amount of $534,241.00 for FY 2017/18.
Recipients of RMRA funding must comply with all relevant federal and state laws, regulations, policies, and procedures.
Below is a general outline of the roles and responsibilities of recipient cities:
• Develop and submit a list of projects to the CTC each fiscal year.
• Develop and submit a project expenditure report to the CTC each fiscal year.
• Comply with all requirements, including reporting requirements, for RMRA funding.
• The City must satisfy the MOE in the fiscal year. That is, the City must expend on street and road general revenues, at least the average of the City’s fiscal year expenditures during FY 2009/10, FY 2010/11, and FY 2011/12.
To satisfy SB1’s requirements of City’s MOE for FY 2017/18, maximize economies of scale and in consideration of the recently completed Pavement Management Study and the Sidewalk Assessment, the project area was expanded, to include the Del Amo Boulevard Rehabilitation from Avalon Boulevard to Central Avenue. On October 3, 2017 the City Council approved a budget amendment and reallocated funding from Project No. 1393 - Annual Overlay project, and Project No. 1413 - Annual Slurry Seal project in order to include the Del Amo Boulevard Rehabilitation Project as part of the Turmont Street Rehabilitation project. These funds are a combination of Gas Tax, Proposition C, and Measure M funds.
The combined-project consists of repair of damaged sidewalks, driveway approaches, cross gutters, curbs and gutters, access ramps, and tree removals. The required concrete improvements were identified as outlined in the 2017 Sidewalk Assessment Report (SAR), and will repair and restore concrete to City standards, meeting the Americans with Disabilities Act (ADA) requirements. This project also includes pavement overlay as outlined in the City’s most recent Pavement Management Program (PMP).
On December 5, 2017, the City Council approved Item No.30 for the PS&E, and authorized staff to advertise the work and call for bids.
On February 22, 2018, six bids were received through PlanetBids and opened by the Director of Finance/Purchasing Division Buyer at the City Clerk’s office, as listed below:

Staff reviewed the bids and found that the lowest responsive and responsible bid was submitted by R.J. Noble Company, with a total bid in the amount of $1,426,509.80. R.J. Noble Company is a bona fide contractor licensed by the state of California. The bid bond, in the amount of 10% of the total bid, as supplied by Western Surety Company, under the laws of the State of South Dakota is in order, and was submitted with the bid. The contractor’s references have been checked, and it has been verified that the contractor has completed similar projects in an acceptable manner. R.J. Noble Company is a member of the Construction Labor Union of Southern California.

V. FISCAL IMPACT
The City is projected to receive partial funding from RMRA in FY 2017/18, as this is the first year of implementation. Based on the January 11, 2018 partial funding projection, the City will receive $534,241.00. These funds shall be used to cover the construction bid received for Project No. 1547 - Turmont Street Rehabilitation.
City Council amended the FY 2017/18 budget and reallocated funds from the Annual Slurry Seal and the Annual Street Overlay projects in order to cover the cost of Project No.1547: Turmont Street Rehabilitation and Project Nos. [1411 & 1393]: Del Amo Boulevard Rehabilitation.
If City Council awards the combined-project contract as recommended, the estimated cost will be the construction bid amount of $1,426,509.80, and construction contingencies in the amount of $187,490.20 213 which total $1,614,000.00.
Funds in this amount are included in the amended FY 2017/18 Proposition C fund, Measure M fund, Gas Tax fund, and the RMRA fund. The funds budgeted are sufficient to cover the project construction, and no additional appropriation is requested as part of this report.
