ADOPTION OF RESOLUTION NO. 17-159 ESTABLISHING ADDITIONAL OPERATING STANDARDS AND RESTRICTIONS FOR COMMERCIAL CANNABIS MANUFACTURING OPERATIONS IN THE CITY OF CARSON  (CITY COUNCIL)

I.                     SUMMARY

The Council introduced for first reading on November 9, 2017, Ordinance 17-1637 to prohibit all commercial cannabis operations in the City except for limited operations (including manufacturing operations) as defined in the ordinance. A resolution to adopt specific additional operating standards and restrictions for manufacturing operations is provided to Council for consideration and adoption.

Staff recommends Council adopt Resolution No. 17-159, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, ESTABLISHING OPERATING STANDARDS AND RESTRICTIONS FOR COMMERCIAL CANNABIS MANUFACTURING OPERATIONS IN THE CITY OF CARSON, AND FINDING AN EXEMPTION FROM CEQA

IV.                     BACKGROUND

At a special City Council meeting held on November 9, 2017, Ordinance No. 17-1637 which both prohibits all commercial cannabis operations except for limited operations (including manufacturing) as defined in the ordinance, while also regulating personal cannabis cultivation stricter than state standards, was introduced for first reading.

Ordinance No. 17-1637 is now agendized at the November 21, 2017 City Council meeting for second reading and adoption. That ordinance provides for a comprehensive set of general regulations applicable to all types of commercial cannabis operations (including manufacturing operations). However, that ordinance does not provide for specific regulations for manufacturing operations (though it does provide for specific regulations for all other authorized types of operations), and it specifically requires the Council to adopt regulations via resolution for manufacturing operations. (See Section 15.160 of Ordinance No. 17-1637.)

Detailed regulations establishing operating standards and restrictions specifically for manufacturing operations are being provided to Council for adoption by resolution.

The proposed regulations for manufacturing mirror the regulations applicable to specific types of operations (provided for in the referenced ordinance), such as location restrictions, sanitation, site requirements, training, restricted access and signage. The proposed regulations add additional standards and restrictions to manufacturing operations concerning areas such as the systems used, health and safety requirements, a fire safety plan, use of a certified industrial hygienist, and equipment standards.
