CONSIDERATION TO ACCEPT AS COMPLETE PROJECT NO. 1540: CURB RAMP IMPROVEMENTS - AVALON BOULEVARD AT BONDS STREET, AND AVALON BOULEVARD AT THE SOUTHERLY CITY LIMITS (CITY COUNCIL)

I. SUMMARY

Project No. 1540: Curb Ramp Improvements - Avalon Boulevard at Bonds Street, and Avalon Boulevard at the Southerly City Limits (Exhibit No. 1) has been completed in accordance with approved plans and specifications by the contractor, Victor Concrete, Inc.
It is requested that the City Council accept the work as complete and authorize staff to file the Notice of Completion. The project was funded entirely from Successor Agency Bonds which were transferred to the City.

II. RECOMMENDATION
Recommendation

TAKE the following actions:
1. ACCEPT as complete Project No. 1540: Curb Ramp Improvements - Avalon Boulevard at Bonds Street, and Avalon Boulevard at the Southerly City Limits.
2. AUTHORIZE staff to file a Notice of Completion.

III. ALTERNATIVES

1. DO NOT ACCEPT the project as complete. However, Civil Code Section 3093 requires a Notice of Completion to be filed for record within 10 days, upon the completion and settlement of all public works project claims, if any.
2. TAKE another action the City Council deems appropriate.


IV. BACKGROUND

The City recently settled a civil case involving non-compliant curb ramps per the American Disabilities Act (ADA) requirements. As part of the original Settlement Agreement, the City was required to reconstruct the existing wheel chair ramps and other related surrounding improvements to bring the area into ADA compliance and to provide a safe travel way for pedestrians. In 2017, a Citywide assessment was conducted on the sidewalks, curb and gutter, and curb ramps, and this project area was determined to be ADA non-compliant.
