CONSIDER EXTENDING THE FINGERPRINTING IDENTIFICATION SPECIALIST SERVICES AGREEMENT WITH THE CITY OF CERRITOS (CITY COUNCIL)

 

Body

I.                     SUMMARY

Since April 1, 2007, the City of Carson has maintained an agreement with the City of Cerritos for fingerprinting identification processing services. Over the course of ten years, this service has proven to be successful in expediting the analysis of fingerprints obtained at crime scenes.

Staff is now seeking Council approval of Amendment No. 8 to the agreement which will extend the agreement for another three years, for the term July 1, 2017 to June 30, 2020, with two one-year options to extend the contract. If approved, funds for this renewal of services will be appropriated for FY 2017/18 through FY 2019/20. Amendment No. 7 to the agreement provided for a term that ended on June 30, 2015, unless the term was extended for two more one-year terms. Staff also seeks Council ratification of these two term extensions for the period of time from July 1, 2015 through June 30, 2017.

 

II.                     RECOMMENDATION

Recommendation

                     TAKE the following actions:                     

1.                     APPROVE ratification of the two, one-year term extensions allowed by Amendment No. 7, which extend the term of services from August 1, 2015 through June 30, 2017, and which otherwise maintain the same term as provided by Amendment No. 7.

 

2.                     APPROVE contract extension Amendment No. 8 with the City of Cerritos for Reimbursement of a Fingerprint Identification Specialist from July 1, 2017 through June 30, 2020 for a not-to-exceed amount of $150,000 on Carson cases at an hourly rate of $42.50 per hour; and, AUTHORIZE the Mayor to execute Amendment No. 8 with the City of Cerritos upon approval as to form by the City Attorney.

1.                     TAKE any other action the City Council deems appropriate that is consistent with the requirements of law.

 

IV.                     BACKGROUND

On April 1, 2007, the city of Carson entered into an agreement with City of Cerritos for Fingerprinting Identification Specialist services. (Exhibit 1) This agreement has since been amended and extended several times, with the last amendment allowing for two one-year extensions ending this June 30, 2017.  

The agreement with Cerritos is separate from the City’s contract with the County for law enforcement services. The County contract for law enforcement services has a provision for crime lab services, but is not inclusive of extended crime analysis such as what is provided in this agreement.  Prior to this contract with the City of Cerritos, fingerprinting identification services were processed at the Sheriff’s Department. However, it took several months before information obtained from fingerprints were transmitted from the crime lab to the Carson Station, thereby delaying the investigation of crimes committed in the City. Carson Sheriff’s Station is committed to serve and protect the residents of the City of Carson. They support the use of the Cerritos lab for faster latent print processing. 

The extension of this contract is in compliance with the Purchasing Ordinance No. 17-1609 approved by Council on February 7, 2017. CMC Section 2611 (i)(7) provides that the purchase of services from other governmental agencies (that are not covered under a specific inter-agency agreement) shall not require compliance with the bidding provisions of the Chapter, so long as funds have been properly appropriated and such purchases conform with all other requirements of the Chapter. Amendment No. 8 is with the governmental agency the City of Cerritos, funds have been properly appropriated for this amendment, and the amendment otherwise confirms with other requirements.

The term on the last amendment to the original contract, Amendment No. 7 (Exhibit No. 2), ended on June 30, 2015. However, Amendment No. 7 provides that the term may be “extended for two, one-year terms in a written agreement executed by the parties.” The City is currently exercising  its 2nd one-year option to extend which will expire on June 30, 2017. The hourly rate of $41.25 on the last two one-year extensions has not changed since Amendment No. 7. Due to staff turnover, the option to extend the contract was exercised inadvertently without a written agreement executed by the parties. Staff now seeks Council approval of ratification of the two, one year extensions of the agreement (as authorized by Amendment No. 7) for the term from July 1, 2015 through June 30, 2017, which is memorialized in Amendment No. 8.

Moving forward, Staff seeks Council approval to extend the agreement with the City of Cerritos for Fingerprinting Identification Specialist (FIS) services for three years from July 1, 2017 through June 30, 2020 with two one-year options to extend as delineated in Amendment No. 8 (Exhibit No. 3). The proposed new Amendment No. 8 includes an increased hourly rate of $42.50 with an amount not-to-exceed $150,000 for three fiscal years beginning July 1, 2017 thru June 30, 2020.

 

V.                     FISCAL IMPACT

Funding for FY 2016/17 has been appropriated and is available in account number 01-50-905-117. Funding for FY 2017/18  will be included in the proposed FY 2017/18 budget. No additional funds are being requested or required.
