CONSIDERATION TO ACCEPT AS COMPLETE PROJECT NO. 1413:  CITYWIDE ANNUAL RUBBERIZED SLURRY SEAL PROGRAM (CITY COUNCIL)

I.                     SUMMARY

Project No. 1413:  The Citywide Annual Rubberized Slurry Seal Program has been completed in accordance with the approved plans and specifications (Exhibit No. 1).  It is requested that the City Council accept the work as complete and authorize staff to file the Notice of Completion.

II.                     RECOMMENDATION

Recommendation

TAKE the following actions:

1.                     ACCEPT as complete Project No. 1413:  Citywide Annual Rubberized Slurry Seal Program.

2.                     AUTHORIZE staff to file a Notice of Completion.

III.                     ALTERNATIVES

1.                     DO NOT ACCEPT the project as complete.  However, Civil Code Section 3093 requires a Notice of Completion to be filed for record within 10 days, upon the completion and settlement of all public works project claims, if any.

2.                     TAKE another action the City Council deems appropriate consistent with the requirements of the law.

IV.                     BACKGROUND

The citywide annual rubberized slurry seal program is listed in the City’s Capital Improvement Program for FY 2016/17.  The Gas Tax fund and slurry seal in-lieu fee are the funding sources for this project.

For this type of project, the City has been utilizing premix rubberized slurry seal, which has superior benefits over conventional slurry seal.  The project locations were selected based on the recommendation of the City’s Pavement Management System MicroPaver Program, input from staff, and the available budget.  In an effort to maximize economies of scale, staff concentrated on Maintenance Zone No. 1, bordered by the SR91 freeway to the south, Avalon Boulevard to the east, 169th Street to the north, and Billings Street to the west. This project also included the north parking lot of Hemingway Park (Gardena Boulevard), and the parking lot of the Carson Park Pool. The selected locations had the highest need for this type of surface treatment which prevents deterioration of the existing pavement.  The attached Location List identifies the street names and limits of the rubberized slurry seal quantities (Exhibit No. 2).  The plans, specifications, and estimates (PS&E) were prepared by the City’s Engineering Services Division staff.

On September 20, 2016, the City Council approved the PS&E, Location Maps, Location List, and ordered the work for Project No. 1413:  Citywide Annual Rubberized Slurry Seal Program.  At the same meeting, the City Council waived the formal bid process defined by the Carson Municipal Code, Section 2604, as allowed by Section 2604(d), and authorized staff to tie into a competitively bid contract between the City of Los Angeles and Petrochem Manufacturing Innovations, LLC (PMI).  The City Council awarded a construction and materials purchase contract to PMI for this project in the amount of $288,344.00 (Exhibit No. 3).

PMI’s responsibility was to provide slurry seal materials and apply them to the roadway; including street sweeping, removal of existing striping from the roadway before applying the slurry seal, and replacing striping after the slurry seal work was completed.  The City was responsible for crack sealing the roadway, providing traffic control during the construction phase, and distributing construction notifications to residents.  The cost associated with staff work (not including salaries), such as materials and rental equipment costs, was covered by the funds budgeted for this project.

The project has been completed, and staff is requesting City Council to accept the work as complete and authorize staff to file a Notice of Completion.

V.                     FISCAL IMPACT

The total amount budgeted for this project was $315,000.00.  $200,000.00 was allocated from Gas Tax (account no. 12-80-999-004-7020/0141), and $115,000 was allocated from the slurry seal in-lieu fee (Fund 71, account 71-00-999-000-2401/3046503).

The actual expenditures for this project totaled $299,711.06, which is $15,288.94 less than the allocated budget.
