CONSIDER THE FIRST AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH PARADIGM ENVIRONMENTAL, INC., FOR CONTINUED SUPPORT WITH THE IMPLEMENTATION OF THE DOMINGUEZ CHANNEL ENHANCED WATERSHED MANAGEMENT PROGRAM (CITY COUNCIL)

I.                     SUMMARY

On September 1, 2015, the City Council approved a Professional Services Agreement with Paradigm Environmental, Inc. (Paradigm), in the amount of $161,540.00, for the preparation of the addendum for the Dominguez Channel (DC) Enhanced Watershed Management Program (EWMP) and implementation support (Exhibit No. 1).

The proposed First Amendment to the Professional Services Agreement with Paradigm involves an additional scope of work for the implementation of the DC EWMP (Exhibit No. 2).

The cost sharing for the continued support with the implementation of the DC EWMP will be paid out of City’s general fund. 

  II.                     RECOMMENDATION

Recommendation

TAKE the following actions:

1.                     APPROVE the First Amendment to the Professional Services Agreement with Paradigm Environmental, Inc., in the amount of $104,750.00, resulting in a total contract sum not-to-exceed $266,290.00.

2.                     AUTHORIZE the Mayor to execute the First Amendment to the Professional Services Agreement with Paradigm Environmental, Inc., following approval as to form by the City Attorney.

1.                     DO NOT APPROVE the First Amendment to the Professional Services Agreement.

2.                     TAKE another action the City Council deems appropriate and consistent with the requirements of the law.

 

IV.                     BACKGROUND

In November 2012, the California Regional Water Quality Control Board (Regional Board) adopted the fourth National Pollutant Discharge Elimination System (NPDES) Permit.  The NPDES Permit was established for the purpose of protecting the beneficial uses of the surrounding cities’ stormwater run-off to the Dominguez Channel (receiving water) in the Los Angeles region by ensuring that stormwater discharges are not causing or contributing to exceedances of applicable water quality permit standards.  These water quality standards have been translated as enforceable provisions of the NPDES Permit in the form of receiving water limitations and water quality effluent limits.  The NPDES Permit allows the permittees to customize their stormwater programs through the development and implementation of a Watershed Management Program (WMP) designed to achieve compliance with receiving water limitations.

On September 1, 2015, the City Council approved a Professional Services Agreement with Paradigm, in the amount of $161,540.00, to identify the necessary revisions to the Dominguez Channel Watershed Management Area Group (DCWMA Group) EWMP, for incorporation into the revised Final DCWMA Group EWMP Addendum.

On December 15, 2015, the City Council approved the submittal of the addenda to the DCWMA Group EWMP (Exhibit No. 3).  The addenda included permit required Reasonable Assurance Analysis (RAA); the identification of Watershed Control Measures, institutional measures and capital improvements that will be funded by the City and implemented through the EWMP.  The EWMP identified Carriage Crest Park as an opportunity site for a regional stormwater capture project, due to its proximity to the City’s storm drain system.

Now that the EWMP has been approved, the City will be in the implementation and adaptive management phase of the EWMP.  The EWMP triggers new approaches to implementing, tracking, and reporting, in order to remain in compliance with the Municipal Separate Storm Sewer System (MS4) Permit.  Paradigm will continue to work closely with the City to facilitate progress with the EWMP implementation and increase the likelihood of success with the MS4 Permit compliance.  The DC EWMP implementation support will include the following:

                     Detailed analysis of the Carriage Crest Park project capture area that will include the investigation of drainage boundaries.

                     Carriage Crest Park dry weather flow characterization.

                     Development of strategies, studies of projects to support EWMP implementation and MS4 compliance.

                     Facilitating coordination among City, the DCWMA Group and/or other MS4 Permit to promote efficiency and consistency when developing strategies, studies or projects.

In summary, staff is seeking City Council approval of the First Amendment to the Professional Services Agreement with Paradigm, which will allow Paradigm to help the City facilitate and implement the adaptive management phase of the EWMP and ensure compliance with the requirements set forth in the NPDES Permit.

 

V.                     FISCAL IMPACT

Funds in the amount of $161,540.00 for this project were included in the FY 2015/16 budget, however, the total cost to complete the project exceeds the amount budgeted; therefore, the budget will need to be increased by $104,750.00.  Funds will be transferred from the general fund balance in the Public Works Department program account 01-80-010-001 in the amount of $54,750.00 and program account 01-80-840-080 in the amount of $50,000.00 totaling $104,750.00 to NPDES account no. 01-80-820-285-6004 in the amount of $104,750.00 for FY 2015/16.
