CONSIDER APPROVAL OF AMENDMENT NO. 5 TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY AND THE CITY OF CARSON FOR PROJECT 919: WILMINGTON AVENUE INTERCHANGE MODIFICATION AT THE I-405 FREEWAY (CITY COUNCIL)

I. SUMMARY
The Carson Successor Agency and the City Council, are undertaking Project No. 919: Wilmington Avenue Interchange Modification at the I-405 Freeway (Exhibit No. 1). The project includes the construction of a new northbound on-ramp, widening Wilmington Avenue from 223rd Street to 220th Street, modifying the existing southbound on-ramp, and the construction of a right-turn lane from Wilmington Avenue northbound to 223rd Street eastbound by widening the existing bridge over the Dominguez Channel (Exhibit No. 2).
The project is partially funded by the Los Angeles County Metropolitan Transportation Authority (MTA), under the 2007 Call for Projects (CFP) program, Proposition C grant. To maintain MTA funding of the project, the fund’s lapsing date needs to be extended. An extension of the fund’s lapsing date through February 28, 2018 was authorized on August 15, 2016 by the MTA Board of Directors. The MTA Board of Directors has requested an Amendment to the Memorandum of Understanding (MOU) between the City of Carson (City) and MTA to memorialize the extension of the fund’s lapsing date. As of the finalization of this report, the City is in receipt from MTA of a (draft) Amendment No. 5 to the MOU which will extend the fund’s lapsing date through February 28, 2018 (Exhibit No. 3).
II. RECOMMENDATION
Recommendation
TAKE the following actions:
1. APPROVE Amendment No. 5 to the Memorandum of Understanding between Los Angeles County Metropolitan Transportation Authority and the City of Carson for Project No. 919: Wilmington Avenue Interchange Modification at the I-405 Freeway, in a form substantial similar to the attached draft, and subject to review, negotiation and final approval by the City Attorney.
2. AUTHORIZE the Mayor to execute Amendment No. 5 to the Memorandum of Understanding between the Los Angeles County Metropolitan Transportation Authority and the City of Carson following approval as to form by the City Attorney.

III. ALTERNATIVES
1. DO NOT APPROVE Amendment No. 5 to the MOU between the MTA and the City of Carson. However, the MTA Board of Directors requires execution of Amendment No. 5 to the MOU in order to continue to fund Project No. 919: Wilmington Avenue Interchange Modification at the I-405 Freeway.
2. TAKE another action the City Council deems appropriate.
IV. BACKGROUND
The Wilmington Avenue Interchange Modification at the I-405 Freeway project was initially listed in the City’s Capital Improvement Program (CIP) for FY 2005/06. Wilmington Avenue essentially runs north/south and the I-405 freeway runs on a due east/west alignment at this location. Wilmington Avenue is an undercrossing and generally provides two lanes in each direction in the project vicinity. The southerly quadrant of the interchange is a standard diamond configuration. The northerly quadrant has a loop on-ramp and an off-ramp, both located in the northeast quadrant. A railroad track crosses 223rd Street and Wilmington Avenue south of the interchange, runs parallel to the I-405 freeway, and limits the opportunities for modifications in the south quadrants.
On September 27, 2007, the MTA Board of Directors authorized a grant in the amount of $11,362,000.00 to the City of Carson to partially fund Project No. 919: Wilmington Avenue Interchange Modification at the I-405 Freeway (MTA identification No. CFP #F1103). An MOU between the MTA and the City of Carson, dated November 13, 2009, was executed by the Mayor, and approved as to form by the City Attorney in January 2010 (Exhibit No. 4). The original MOU had a lapsing date of June 2012 and had to be amended due to a delay in construction caused by several challenges.
Since the original lapsing date of June 2012, the MOU has been amended four times over the last four consecutive years, in order to extend the funding of the project. The most recent extension was approved by City Council on January 19, 2016 (Exhibit Nos. 5-6). On August 25, 2016, the MTA Board of Directors granted an extension, for the lapsing date, through February 28, 2018. The MTA Board of Directors approved a 20-month lapsing date extension from the last year of programming and eliminates interim lapsing dates.
As of the finalization of this report, the City is in receipt from MTA of a draft Amendment No. 5 to the MOU which is subject to modification by MTA (Exhibit No. 3). In the interests of expediency and to maintain uninterrupted project funding, Staff requests that the City Council approve the draft Amendment No. 5 to the MOU between the City and MTA, subject to review, negotiation and final approval by the City Attorney’s Office.
Approval of the amendment will formalize the extension of funding granted by the MTA Board of Directors.
