CONSIDER ADOPTION OF RESOLUTION 24-048, APPROVING A FUNDING AGREEMENT BETWEEN LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY (METRO) AND THE CITY OF CARSON ACCEPTING MEASURE M FUNDING IN THE AMOUNT OF $5,384,400.00 FOR PROJECT NO. 1452: BIKE LANE INSTALLATION - 223RD ST, AVALON BOULEVARD, CENTRAL AVENUE, DEL AMO BOULEVARD, AND UNIVERSITY DRIVE.

I.                     SUMMARY

The City of Carson (City) is planning to undertake Project 1452: Bike Lane Installation - 223rd St., Avalon Boulevard, Central Avenue, Del Amo Boulevard, and University Drive.

Grant funds from Los Angeles County Metropolitan Transportation Authority (Metro) Measure “M” funds in the amount of $5,384,400 were awarded to the City in accordance with the terms of the Funding Agreement for the construction phase.

The Metro Board requires the execution of the Funding Agreement between the City and Metro, and staff now seeks City Council approval of the same to fund the project (Exhibit No. 1).

II.                     RECOMMENDATION

Recommendation

                                          TAKE the following actions:

1.                     ACCEPT grant funds in the amount of $5,384,400.00.

2.                     WAIVE further reading and ADOPT Resolution 24-048. “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, APPROVING MEASURE M FUNDING AGREEMENT 9200000000M460110 FOR PROJECT 1452: BIKE LANE INSTALLATION -223RD STREET, AVALON BOULEVARD, CENTRAL AVENUE, DEL AMO BOULEVARD, UNIVERSITY DRIVE, LACTMA PROJECT ID# MM4601.10 AND FTIP# LA9919335.

III.                     ALTERNATIVES

DO NOT APPROVE the Funding Agreement, however, the City must execute this funding agreement in order to receive grant funds for this project. Invoices for reimbursement cannot be submitted to Metro until this funding agreement is fully executed.

IV.                     BACKGROUND

The City’s Capital Improvement Program (CIP) calls for the design and construction of Project 1452: Bike Lane Installation - 223rd St., Avalon Boulevard, Central Avenue, Del Amo Boulevard, and University Drive.

In 2017, the City of Carson received $1,263,500 in HSIP funding for the design and construction of the project. Of that total, $134,400 was obligated for the preliminary engineering phase, with $1,129,100 remaining to be used for construction.  The City has also committed $125,600 of local funds to the construction phase, as the required local match for the HSIP funding. 

Since 2017, change in scope of work and price escalation increased the estimate for the project significantly. Staff was directed to reverse the original plan to include a protected bike lane that would provide greater safety for cyclists by installing a separation in between travel lanes and bike lanes. To accomplish this goal, it became necessary to narrow the width of the travel lanes and the width of the existing raised and painted medians in some locations to provide room for the separation. This change in scope resulted in a huge increase in cost which prompted staff to seek additional funding. In 2023, City applied for an additional $5,384,400 fund from Metro to cover the difference between the HSIP funding and the estimated project cost.

Metro Measure “M” funds were awarded to the City to cover the $5,384,400 anticipated additional construction cost in accordance with the terms of the Funding Agreement (Exhibit No. 1). Through City Council’s adoption of the proposed resolution, staff now seeks City Council approval of the Funding Agreement with Metro for the grant to the City in the amount of $5,384,400 to be made on a reimbursement basis.

V.                     FISCAL IMPACT

The Funding Agreement under consideration will provide the opportunity for the City of Carson to be reimbursed for an amount not-to-exceed $5,384,400.00 from Metro for CIP Project No. 1452: Bike Lane Installation - 223rd St., Avalon Boulevard, Central Avenue, Del Amo Boulevard, and University Drive.

The Metro Measure M grant funds will be utilized next Fiscal Year and will be incorporated into the FY 2024-2025 special revenue funds budget.
