CONSIDER AWARD OF A CONSTRUCTION CONTRACT TO ONYX PAVING COMPANY FOR PROJECT NO. 1722: 213TH STREET PAVEMENT REHABILITATION AND CONCRETE REPLACEMENT FROM MAIN STREET TO SELWYN AVENUE (CITY COUNCIL)

I.                     SUMMARY

Project No. 1722: 213TH Street Pavement Rehabilitation and Concrete Replacement Project from Main Street to Selwyn Avenue is part of the city’s fiscal year 2024/25 Capital Improvement Program (CIP) (Exhibit No. 1). This project is funded by Measure M and Measure R funds and includes pavement rehabilitation and concrete reconstruction improvements.

The Invitation for Bids (IFB) No. 24-11 was advertised in a paper of local circulation and through the PlanetBids portal from July 8, 2024 to July 29, 2024. Three bids were received and opened at the City Clerk’s Office. It was determined that Onyx Paving Company was the lowest responsive and responsible bidder, with a total bid amount of $2,693,000.00.

Staff requests that the City Council award a construction contract to Onyx Paving Company in the amount not to exceed $2,693,000.00 (Exhibit No. 2) and approve a 10% contingency in the amount of $269,300 for any unforeseen extra work to complete the project. To complete the project the total amount of the project including a 10% contingency is $2,962,300.00.

II.                     RECOMMENDATION

Recommendation

TAKE the following actions:

1.                     AWARD a construction contract for Project No. 1722: 213th Street Pavement Rehabilitation and Concrete Replacement Project from Main Street to Selwyn Avenue, for a not to exceed amount of $2,693,000.00, to the lowest responsive and responsible bidder, Onyx Paving Company.

2.                     AUTHORIZE the expenditure of construction contingencies in the amount of $269,300 (10%) for any unforeseen construction work such as substructure conflicts, contaminated soil removal and disposal, material testing, and other additional work the city may request as appropriate that may be necessary to complete this project.

3.                     AUTHORIZE the Mayor to execute the Construction Contract with Onyx Paving Company following approval as to form by the City Attorney.

III.                     ALTERNATIVES

1.                     REJECT all bids.

2.                     TAKE another action that the City Council deems appropriate consistent with the requirements of the law.

IV.                     BACKGROUND

Project No. 1722 - 213t Street Pavement Rehabilitation and Concrete Replacement from Main Street to Selwyn Avenue is included in the City’s CIP. The project consists of grinding existing asphalt pavement surface, removal and reconstruction of deteriorated roadway section, laying down of asphalt concrete leveling course and asphalt rubberized hot mix (ARHM), installation of pavement markings, re-striping, and other related work.

The project also consists of the repair of damaged sidewalks, driveway approaches, curbs and gutters, access ramps, and tree removals and replacement. The required concrete improvements will repair and restore concrete to city standards and meet the Americans with Disabilities Act (ADA) requirements.

The project was advertised for construction bids through IFB No. 24-11, and on July 29, 2024, three bids were received through PlanetBids and opened by the Purchasing Division Manager at the City Clerk’s office (Exhibit No. 3). The bid results are as listed below:

Staff reviewed the bids and determined that the lowest responsive and responsible bid was submitted by Onyx Paving Company, with a total bid in the amount of $2,693,000.00. Onyx Paving Company is a bonafide contractor licensed by the State of California. The bid bond, in the amount of 10% of the total bid, as supplied by SiriusPoint America Insurance Company, a New York corporation, is in order, and was submitted with the bid. The contractor’s references have been checked, and it has been verified that the contractor has completed similar projects in an acceptable manner.

The timeline for this project is as follows:

The project may experience delays depending on weather conditions and other unknown items, and staff may have to adjust the project schedule accordingly.

Staff requests that the City Council award a Construction Contract to Onyx Paving Company in the amount not to exceed $2,693,000.00 and approve a 10% contingency in the amount of $269,300 for any unforeseen work needed to complete the project.

V.                     FISCAL IMPACT

The total construction bid amount for this improvement project is $2,693,000.00. A construction contingency in the amount of $269,300.00, representing 10% of the total construction bid, is requested for any unforeseen construction work that may be required to complete this project. The total project cost including the 10% contingency is $2,962,300.00. The funds for the project cost have been included in the FY 24/25 budget per the City's CIP plan with $1,086,368 allocated from Measure R account 254-80-820-904-8009 and $2,348,539 Measure M account 281-80-820-904-8009.
