CONSIDERATION TO ACCEPT THE PROJECT AS COMPLETE, PROJECT NO.1735: CIVIC CENTER LANDSCAPE RENOVATION PROJECT (CITY COUNCIL)

I.                     SUMMARY

On January 3, 2023, City Council awarded a construction contract to Marina Landscape, Inc. for Project No.1735: Civic Center Landscape Renovation for an amount not to exceed $1,617,311.50 for the project. The project included the removal and replacement of the ornamental grass around City Hall and Community Center, replacing with drought tolerant plant materials. The project also included irrigation installation as well as the layout of new pathways and seating areas. City Council also authorized the expenditures of $242,596.73 (15%) for any unforeseen construction work that may have been necessary to complete the project. Due to changes during construction and maintenance period extension, change orders amounting to $226,954 were issued during construction.

The project has been completed in accordance with the approved plans and specifications. It is requested that the City Council accept the work as complete and authorize staff to file the Notice of Completion with the Los Angeles County Recorder’s Office.

II.                     RECOMMENDATION

Recommendation

                     Take the following actions:

1.                     ACCEPT as complete, Project No.1735, Civic Center Landscape Renovation Project.

2.                     AUTHORIZE Staff to file a Notice of Completion.

III.                     ALTERNATIVES

1.  DO NOT ACCEPT the project as complete. However, acceptance of projects as complete and recordation of a Notice of Completion after work completion, under Civil Code section 9204 will shorten the time period during which any contractor will be able to file a lien claim.

2.                     TAKE another action the City Council deems appropriate consistent with the requirements of the law.

IV.                     BACKGROUND

Project No.1735: Civic Center Landscape Renovation is one of the City’s Capital Improvement Program (CIP) Projects. On January 3, 2023, the City Council awarded a construction contract to Marina Landscape for Project No:1735 - Civic Center Landscape Renovation for an amount of not to exceed $1,617,311.50 A construction contingency in the amount of $242,596.73 (15%) for any unforeseen work during construction was also authorized. The Civic Center Landscape Renovation Project included (i) removal of existing ornamental grass, (ii) addition of new irrigation system and controls (iii) addition of walking decomposed granite paths with concrete borders (iv) installation of mulch, and (v) planting of thirty-one different variety of shrubs, groundcovers, and succulents.  

The City retained the services of Westberg+White Architects and ADL Planning Associates, Inc. to complete the plans, specifications, and estimates for this project. The project was partially refunded with grants and rebates from California Water Service Company (CalWater) and West Basin Municipal Water District (WBMWD) totaling $388,377.00, both of which have a vested interest in drought tolerant landscaping and improvements in water use at government facilities.

The contract was extended beyond the anticipated end of construction to augment the additional maintenance needs of the new planting material and landscapes.

The project has been completed in a satisfactory manner, the landscape is established and growing, and residents are using the new walking paths and the seating areas. Marina Landscape has submitted the completed paperwork needed to finalize the project. The final construction cost for this project came to the amount of $1,844,265.50 including change orders amounting to $226,954 that were issued during construction. Staff is requesting that City Council accept the project as complete and authorize staff to proceed with the filing of the Notice of Completion.

V.                     FISCAL IMPACT

None. The total budgeted amount for this project was $1,859,908.23, including construction contingency funded by the General Fund. The expenditures for this project were $1,844,265.50, resulting in the project to be under budget by $15,642.73.
