CONSIDERATION OF RESOLUTION NO. 24-041 APPROVING PROGRAM SUPPLEMENT AGREEMENT NO. A523 TO THE ADMINISTERING AGENCY-STATE MASTER AGREEMENT NO. 07-5403S21 FOR STATE FUNDED PROJECTS FOR PROJECT NO. 1534 [FEDERAL NO. ATPL-5403(032)]: CITY-WIDE COMMUNITY SAFETY IMPROVEMENTS (CITY COUNCIL)

I. SUMMARY
Project No. 1534 - Citywide Community Safety Improvements was listed in the City’s Capital Improvement Program (CIP). The City of Carson was awarded a grant for Project No. 1534 - Citywide Community Safety Improvements and has been authorized by the State to proceed with the project. The funding for this project is provided by the Active Transportation Program (ATP) State fund. According to the California Department of Transportation (Caltrans), adoption of a resolution by the City Council authorizing the execution of the Program Supplement Agreement to the Administering Agency-State Master Agreement No. 07-5403S21 between the State and the City is required (Exhibit No. 1).
Program Supplement Agreement No. A523 obligates up to $30,000 in ATP State funds for the Project Approval & Environmental Document (PA&ED) phase of the City-Wide Community Safety Improvements project, with no local match required (Exhibit No. 2).
II. RECOMMENDATION

WAIVE further reading and ADOPT Resolution No. 24-041, “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, APPROVING PROGRAM SUPPLEMENT NO. A523 TO ADMINISTERING AGENCY-STATE AGREEMENT FOR STATE-FUNDED PROJECTS NO. 07-5403S21 FOR THE PROJECT APPROVAL & ENVIRONMENTAL DOCUMENT PHASE OF FEDERAL PROJECT NO. ATPL-5403(032): CITY-WIDE COMMUNITY SAFETY IMPROVEMENTS”

III. ALTERNATIVES
1. Do NOT ADOPT Resolution No. 24-041. However, if the City does not execute the Program Supplement Agreement, it would not be eligible to receive State funds for this project. No invoices for reimbursement can be submitted to Caltrans until the Program Supplement Agreement is fully executed.
2. TAKE another action the City Council deems appropriate.
IV. BACKGROUND
Project No. 1534- Citywide Community Safety Improvements will improve bicycle and pedestrian infrastructure and safety with a Type 2 bike lane on Santa Fe Boulevard between Del Amo Boulevard and South City Limit, and high visibility crosswalks, countdown pedestrian signals, and curb ramp improvements at various locations within the City of Carson.
The City of Carson applied for funds for the Citywide Community Safety Improvements project in June 2022 through Cycle 6 of the ATP. The city first received notification in January 2023 that Metro was considering funding the project. The California Transportation Commission approved the funding of $3,451,000 for the Citywide Community Safety Improvements in June 2023.
The City of Carson administers State funded projects under the auspices of the current Administering Agency-State Master Agreement between the City of Carson and State of California. An updated version of this agreement (Master Agreement No. 07-5403S21) is also being presented on this agenda as one of the consent items (File ID No. 2024-0314) for consideration of the City Council.
In order to be eligible for reimbursement, each individual project that is State funded must have a Program Supplement Agreement that is executed by adopting a Resolution. The resolution under consideration would obligate the expenditure of up to $30,000.00 for the Project Approval & Environmental Document (PA&ED) phase of the City-Wide Community Safety Improvements project, which would be reimbursed through the ATP grant. The deadline to use the $30,000 for the PA&ED phase of the project will be June 30, 2026. A total of $3,451,000.00 of ATP grant funds has been awarded for this project. The rest of the grant fund is allocated for the Plans, Specifications, and Estimate (PS&E) and Construction (CON) phases and will be obligated through execution of future Program Supplemental Agreement(s).
Staff requests City Council adopt Resolution No. 24-041 to allow the obligation of a $30,000 grant fund and allow staff to proceed with the next phase of the project.
V. FISCAL IMPACT
The Program Supplemental Agreement under consideration will provide the opportunity for the City of Carson to be reimbursed for an amount not-to-exceed $30,000.00 from the ATP grant fund for the PA&ED phase of the City-Wide Community Safety Improvements project and is required to appropriate funding for the reimbursable work under the agreement. The ATP grant funds will be utilized next fiscal year (FY) and incorporated into the FY 2024-2025 special revenue funds budget.
