CONSIDER APPROVAL OF A PURCHASE ORDER TO OCEAN BLUE ENVIRONMENTAL SERVICES INC. FOR INVOICES FOR SERVICES RENDERED TO CLEAN UP AND DISPOSE OF HAZARDOUS MATERIALS CITYWIDE (CITY COUNCIL)

I.                     SUMMARY

As defined by Purchasing Ordinance 23-2309, § 2604, “City Council shall approve all Purchases with an estimated amount per Purchase Matter and contractor/vendor greater than $75,000.” During fiscal year (FY) 2023/24, services from Ocean Blue Environmental Services Inc. (Ocean Blue) exceeded the $75,000 threshold and City Council approval is requested to proceed with payments of all outstanding invoices received to date from Ocean Blue (Exhibit 1).II.                     RECOMMENDATION

Recommendation

                     TAKE the following actions:

1.                     WAIVE the contract requirements of the Carson Municipal Code (“CMC”) pursuant to Carson Municipal Code 2605(b)(2)(ii); and

2.                     AUTHORIZE the Purchasing Department to issue a Purchase Order to Ocean Blue in the total amount of $28,347.80 to pay three (3) outstanding invoices received to date for FY 23/24.

IV.                     BACKGROUND

Ocean Blue provides environmental cleanup and are equipped to handle a wide range of hazardous substances, ensuring a thorough and efficient cleanup process. They adhere to industry regulations and guidelines to protect both their team and the environment. Their personnel possess the necessary certifications and experience to handle hazardous materials, including chemicals, biological waste, radioactive materials, and more with the utmost care and expertise. Their cleanup process is tailored to each unique situation, ensuring a comprehensive and effective approach. They begin by conducting a thorough assessment of the contaminated area, identifying the type and extent of the hazardous material present. They then develop a customized cleanup plan that aligns with the specific requirements of the situation. They utilize state-of-the-art equipment and specialized techniques to safely remove, transport, and dispose of the hazardous materials responsibly and in compliance with all environmental regulations.

Their services help the City handle hazardous materials within the public right of way where there are no responsible parties identified and most likely have originated from various sources such as traffic collisions, fire or any illegal dumping. Public Works calls for Ocean Blue’s services if the magnitude of the cleanup is beyond the City crew’s capabilities. A recent clean-up of solvents, motor oil, paint and hazardous waste was required to be cleaned and properly disposed.  The cleanup was extensive and required several preventive measures to ensure compliance with environmental regulations.

The cost for this recent service was unexpectedly high due to the magnitude and frequency of cleanups done by Ocean Blue which exceeded the purchase order amount. Due to the nature of the vendor’s work, most of the additional services were approved in urgent and emergent situations; limiting staff’s ability to amend the vendor’s purchase order prior to services being rendered.  Since the current purchase order has been exhausted, staff has secured a piggyback contract to handle similar incidents (Exhibit 2).

V.                     FISCAL IMPACT

Funds for these services were included in the FY 23/24 budget in the Public Works Hazardous Waste Account 101-80-840-279-6019.
