CONSIDER ADOPTION OF RESOLUTION NO. 19-058 AND AWARD OF A CONSTRUCTION CONTRACT TO R.J. NOBLE COMPANY FOR PROJECT NO. 1603 - ALBERTONI STREET REHABILITATION FROM FIGUEROA STREET TO CENTRAL AVENUE, THE CITY'S SECOND SB-1 PROJECT (CITY COUNCIL)

I. SUMMARY
On February 7, 2019, the City Council approved the plans, specifications and estimates (PS&E) for Project No. 1603: Albertoni Street Rehabilitation from Figueroa Street to Central Avenue (Exhibit Nos. 1 and 2). This project is the City’s second SB-1 project funded by Road Maintenance and Rehabilitation Account (RMRA) funds.
The Invitation for Bids (IFB) was advertised in the Our Weekly Publication, and through the PlanetBids portal from February 8, 2019 to February 22, 2019. Eight bids were received, and it was determined that R.J. Noble Company was the lowest responsive and responsible bidder, with a total bid amount of $1,476,609.35.
II. RECOMMENDATION
Recommendation
TAKE the following actions:
1. AWARD a Construction Contract for Project No. 1603: Albertoni Street Rehabilitation from Figueroa Street to Central Avenue, in the amount of $1,476,609.35, to the lowest responsive and responsible bidder, R.J. Noble Company.
2. AUTHORIZE the expenditure of construction contingencies in the amount of $221,491.40 (15%) for any unforeseen construction work such as substructure conflicts, contaminated soil removal and disposal, material testing, and other work that may be necessary to complete this project.
3. WAIVE further reading and ADOPT Resolution No. 19-058: “A RESOLUTION OF THE CITY OF CARSON CITY COUNCIL AMENDING THE FISCAL YEAR 2018-19 BUDGET IN THE GENERAL FUND.”
4. AUTHORIZE the Mayor to execute a Construction Contract following approval as to form by the City Attorney.

IV. BACKGROUND
On May 1, 2018, the City Council approved Item No. 26, approving Project No. 1603 - Albertoni Street Rehabilitation from Figueroa Street to Central Avenue for Fiscal Year 2018-19 (Exhibit No.3). This will be the City’s second Road Repair and Accountability Act of 2017 (SB-1) project.
SB-1 established new Road Maintenance and Rehabilitation Account (RMRA) funds which are allocated to the City every Fiscal Year. Based on the report from the California Transportation Commission (CTC) dated January 11, 2018, the City will be receiving RMRA funding in the amount of $1,555,555.00 for FY 2018/19.
Recipients of RMRA funding must comply with all relevant federal and state laws, regulations, policies, and procedures. Below is a general outline of the roles and responsibilities of recipient cities:
• Develop and submit a list of projects to the CTC each Fiscal Year.
• Develop and submit a project expenditure report to the CTC each Fiscal Year.
• Comply with all requirements for RMRA funding.
• The City must satisfy the Maintenance of Effort (MOE) in the Fiscal Year. That is, the City must expend on street and road general revenues, at least the average of the City’s Fiscal Year expenditures during FY 2009/10, FY 2010/11, and FY 2011/12.
On February 7, 2019, the City Council approved Item No.3, approving the PS&E, and authorizing staff to advertise the work and call for construction bids for Project No. 1603 - Albertoni Street Rehabilitation from Figueroa Street to Central Avenue. The project consists of repair of damaged sidewalks, driveway approaches, cross gutters, curbs and gutters, access ramps, and tree removals. The required concrete improvements were identified as outlined in the 2017 Sidewalk Assessment Report (SAR), and will repair and restore concrete to City standards, and meet the Americans with Disabilities Act (ADA) requirements. This project also includes pavement overlay as outlined in the City’s 2017 Pavement Management Program (PMP).
The project was advertised for construction bids, and on February 28, 2019, eight bids were received through PlanetBids and opened by the Purchasing Division Manager at the City Clerk’s office. The bid results are as listed below:

Staff reSStaffThStaff reviewed the bids and determined that the lowest responsive and responsible bid was submitted by R.J. Noble Company, with a total bid in the amount of $1,476,609.35. R.J. Noble Company is a bona fide contractor licensed by the State of California
The bid bond, in the amount of 10% of the total bid, as supplied by Western Surety Company, under the laws of the State of South Dakota is in order, and was submitted with the bid. The contractor’s references have been checked, and it has been verified that the contractor has completed similar projects in an acceptable manner. In addition, R.J. Noble recently completed the City’s first SB-1 project, the Turmont Street Rehabilitation project which was completed within budget and on time. R.J. Noble Company is a member of the Construction Labor Union of Southern California.

V. FISCAL IMPACT
The total construction bid amount for this improvement project is $1,476,609.35. A construction contingency in the amount of $221,491.40, representing 15% of the total construction bid, is requested for change orders and other unforeseen construction work that may be required to complete this project. The total project cost including 15% contingency is $1,698,100.75. The City is projected to receive funding from RMRA in the amount of $1,555,555.00 for FY 2018/19. These funds are included in the adopted FY 2018/19 RMRA fund. The shortfall to cover the contingency fund for this project will be addressed by transferring the surplus funds from Project No. 1413 to account no. 288-80-820-904-8009, which will be accomplished by amending the General Fund Budget for FY 2018-19 via Resolution (Exhibit No. 4).
