I. SUMMARY
Prior to the FY18/19 budgeting process, the City eliminated and defunded 4 FTE positions in the Risk Management Division of the Human Resources & Risk Management Department. The Human Resources & Risk Management Department is the only City department that does not have manager level staff. The Department of Human Resources & Risk Management requires a manager to effectively manage and maintain the risk activities. As part of the FY 21/22 Budget, the City Council approved hiring a Risk Manager and added funding as detailed in the Fiscal Impact section below. This item before the City Council is the next step in the process to fill that position.
To ensure that the City is able to continue to meet the required risk needs, Staff is proposing establishment of a new classification, Risk Manager. The proposed resolution would: (1) adopt the new classification, to be added to the City's classification plan; (2) adopt a classification specification for the new classification; (3) assign the new classification to Salary Range 171 to be included in the City's compensation plan; and (4) assign the new classification to the American Federation of State, County, and Municipal Employees Union, Council 36, Local 1017 (AFSCME LOCAL 1017).

IV. BACKGROUND
The Human Resources & Risk Management Department (Department) is the only City department without staff at the Manager level. The Department previously had six (6) staff in Risk Management to properly address the City’s needs. The exempt level staff retired in 2018 and the other staff were at a non-exempt clerical level. With the exception of the Senior Risk Management Analyst role, none of the positions were ever backfilled. The former employee in the Senior Risk Management Analyst role retired in 2018. The current incumbent Senior Risk Management Analyst has been in this role since 2018. The Senior Risk Management Analyst role currently has two direct reports, neither of whom are 100% dedicated to Risk Management.
The Risk Manager will be responsible for protecting the City’s assets by providing critical functions including implementation of key citywide programs such as safety management, return-to-work, workers compensation, employment liability, general liability, first party property claims, the City’s insurance policies/programs and vendor contract insurance. The Risk Manager will be City’s point person for health and safety compliance including interactions with external agencies such as LA County Department of Public Health and CAL OSHA. The Risk Manager will coordinate the City’s ADA (Americans with Disabilities Act) compliance activities, working in concert with other internal departments, including conducting interactive meetings and assessments of City facilities.
Staff is seeking City Council approval to establish the Risk Manager job classification. The classification specification is attached to the proposed resolution as Exhibit “A.” The proposed resolution would: (1) adopt the new classification, to be added to the City's classification plan; (2) adopt a classification specification for the new classification; (3) assign the new classification to Salary Range 171 ($10,498 - $13,399) to be included in the City's compensation plan; and (4) assign the new classification to the American Federation of State, County, and Municipal Employees Union, Council 36, Local 1017 (AFSCME LOCAL 1017).
The new classification of Risk Manager will be expected in the course and scope of their duties to have access to information related to, and/or participate in, the City’s administration of Employer-Employee relations and is therefore designated as a Confidential position pursuant to the City’s Employer-Employee Relations Resolution No. 85-107. The Director of Human Resources & Risk Management has consulted with the affected department director, and completed the meet and confer requirement on March 1, 2021 with the representatives of the affected recognized employee organization, American Federation of State, County, and Municipal Employees Union, Council 36, Local 1017 (AFSCME 1017) pursuant to the City’s obligations under the MMBA concerning the proposed adoption of the Risk Manager classification, and both parties are in agreement with the new role and proposed classification specification.
The Director of Human Resources & Risk Management also Meet & Conferred with the labor representative of the Association of Management Employees (AME) on May 19, 2021 and reached agreement and concurrence that the new Risk Manager classification properly belongs in the Confidential employee bargaining unit.
V. FISCAL IMPACT
There is no fiscal impact to the General Fund as the Risk Manager role was funded for $102,000 fully loaded in the FY21/22 general fund budget.
