CONSIDERATION TO ACCEPT AS COMPLETE PROJECT NO. 1540: CURB RAMP IMPROVEMENTS - AVALON BOULEVARD AT BONDS STREET, AND AVALON BOULEVARD AT THE SOUTHERLY CITY LIMITS (CITY COUNCIL)

I. SUMMARY
Project No. 1540: Curb Ramp Improvements - Avalon Boulevard at Bonds Street, and Avalon Boulevard at the Southerly City Limits (Exhibit No. 1) has been completed in accordance with approved plans and specifications by the contractor, Victor Concrete, Inc.
It is requested that the City Council accept the work as complete and authorize staff to file the Notice of Completion. The project was funded entirely from Successor Agency Bonds which were transferred to the City.
II. RECOMMENDATION
Recommendation
TAKE the following actions:
1. ACCEPT as complete Project No. 1540: Curb Ramp Improvements - Avalon Boulevard at Bonds Street, and Avalon Boulevard at the Southerly City Limits.
2. AUTHORIZE staff to file a Notice of Completion.

III. ALTERNATIVES
1. DO NOT ACCEPT the project as complete. However, Civil Code Section 3093 requires a Notice of Completion to be filed for record within 10 days, upon the completion and settlement of all public works project claims, if any.
2. TAKE another action the City Council deems appropriate.
IV. BACKGROUND
The City recently settled a civil case involving non-compliant curb ramps per the American Disabilities Act (ADA) requirements. As part of the original Settlement Agreement, the City was required to reconstruct the existing wheel chair ramps and other related surrounding improvements to bring the area into ADA compliance and to provide a safe travel way for pedestrians. In 2017, a Citywide assessment was conducted on the sidewalks, curb and gutter, and curb ramps, and this project area was determined to be ADA non-compliant. Engineering Services Division staff completed the preparation of Plans, Specifications and Estimates (PS&E) for the improvement of the wheel chair ramps, in early 2017.
On April 18, 2017, the City Council approved Item No. 17: the PS&E for Project No. 1540: Curb Ramp Improvements - Avalon Boulevard at Bonds Street, and Avalon Boulevard at the Southerly City Limits, and authorized staff to advertise the work and call for construction bids.
On June 14, 2017, two bids were received by PlanetBids, then opened and reviewed by the Purchasing Division.
On July 18, 2017, the City Council approved Item No. 22, awarding a construction contract for Project 1540: Curb Ramp Improvements - Avalon Boulevard at Bonds Street, and Avalon Boulevard at the Southerly City Limits, to the lowest responsive and responsible bidder, Victor Concrete, Inc., in the amount of $69,565.00.
The improvements for this project included the following:
a. Excavation and reconstruction of six access ramps to comply with City standards and ADA requirements.
b. Construction of approximately 700 square feet of sidewalk to join with the adjacent proposed ramps.
c. Reconstruction of a new larger radial corner, curb and gutter, and sidewalk area at the Northeast corner of the Avalon Boulevard and Bonds Street intersection, to join with existing pavement.
d. Demolition, reconstruction, and modification of the top slab of two existing catch basins to accommodate adjacent handicap curb ramps.
All of the required improvements, as part of this project, have been satisfactorily completed by the contractor and accepted by staff. The location data and repair quantities have been incorporated into the City’s Geographic Information system (GIS) and the Sidewalk Assessment Report (SAR) to reflect the reduction in substandard concrete as a result of this project. City Council is requested to accept the project as complete and authorize staff to file a Notice of Completion, which will allow staff to release the retention payment to the contractor.
V. FISCAL IMPACT
Funds for this project were allocated under the Infrastructure/Roadways Pavement Budget, Account No. 84-70-999-985-8020/0154001. City Council awarded the original estimated amount of $60,000.00 by Resolution No. 17-053 (Exhibit No. 2), and an additional amount of $20,500.00 was appropriated by Resolution No. 17-090 (Exhibit No. 3) in order to meet the estimated project cost of $80,500.00. This project cost consisted of a construction bid of $69,565.00, plus a construction contingency of $10,935.00.
The total actual project cost of these improvements was $65,591.99, which is $14,908.01 below the budgeted fund. The 5% retention payment of $3,272.49 for Victor Concrete, Inc. will be withheld until the filing of the Notice of Completion.
