CONSIDER THE CITY OF CARSON COMMUNITY FACILITIES DISTRICT NO. 2018-01 (MAINTENANCE AND SERVICES) ANNUAL REPORT AS REQUIRED BY STATE SENATE BILL 165 (CITY COUNCIL)

I. SUMMARY
The City of Carson Community Facilities District No. 2018-01 (“CFD”) is subject to the Local Agency Special Tax and Bond Accountability Act under SB 165 (“SB 165”). SB 165 requires the filing of an annual report (“Annual Report”) with the City Council acting in its capacity as the legislative body of the CFD. The Annual Report provides information pertaining to the CFD including collected revenue and expenditures. The Annual Report has been prepared to comply with Sections 50075 through 50077 of California Government Code.
II. RECOMMENDATION
Recommendation

IV. BACKGROUND
SB 165 requires the Annual Report (Exhibit No. 1) for Fiscal Year 21-22 to contain the following information:
1. A statement indicating the specific purposes of the special tax,
2. Require that the proceeds of the special tax be applied to those purposes,
3. Require the creation of an account into which the proceeds shall be deposited, and
4. Require an annual report containing specified information concerning the use of the proceeds.
Additionally, Section 50075.3 of California Government Code states:
“The chief fiscal officer of the levying local agency shall file a report with its governing body no later than January 1, 2002, and at least once a year thereafter. The Annual report shall contain all of the following:
(a) The amount of funds collected and expended.
(b) The status of any project required or authorized to be funded as identified in
subdivision (a) of Section 50075.1(a).”
Accordingly, this Annual Report has been reviewed the CFD’s chief fiscal officer and is being submitted to the governing body for receive and file.
SB 165 Statement of Purpose of CFD Special Tax
The statement of purpose of the CFD is as follows: To fund certain municipal services associated with new industrial and multi-family residential developments. The services consist of, but are not limited to: law enforcement services, street sweeping/sidewalk cleaning and maintenance, maintenance of parks, parkways, and open space, maintenance of roadways, flood and storm protection services, and other eligible services permitted by the Act to service properties within the boundaries of the CFD.
CFD No. 2018-01 Services Fund
The following table shows the amount of CFD revenue collected, expenditures and fund balance as of June 30, 2022. Since its formation in 2018, the CFD has collected $243,245. No expenditures have been recorded as of June 30, 2022.
V. FISCAL IMPACT
None. There are no fiscal impacts associated with the receiving and filing of this Annual Report.
