CONSIDERATION TO ACCEPT THE PROJECT AS COMPLETE, PROJECT NO. 919 WILMINGTON AVENUE AND 223RD STREET - PULL BOX ACCESS IMPROVEMENTS (CITY COUNCIL)

I. SUMMARY
On December 5, 2023, the City Council awarded a Construction Contract to HZS Engineering, Inc. for $113,700.00 for Project No. 919: Wilmington Avenue and 223rd Street - Pull Box Access Improvements. The City Council also authorized the expenditure of construction contingencies of $11,370.00 (10%) for any unforeseen construction work that may have been necessary to complete this project. Project No. 919 has been completed in accordance with approved plans and specifications. It is requested that the City Council accept the project as complete and authorize staff to file the Notice of Completion with the LA County Recorder’s office.
II. RECOMMENDATION
Recommendation
TAKE the following actions:
1. ACCEPT as complete Project No. 919: Wilmington Avenue and 223rd Street - Pull Box Access Improvements.
2. AUTHORIZE staff to file a Notice of Completion.

III. ALTERNATIVES
1. DO NOT ACCEPT the project as complete. However, acceptance of projects as complete and recordation of a Notice of Completion after work completion, under Civil Code section 9204 will shorten the time period during which any contractor will be able to file a lien claim.
2. TAKE another action the City Council deems appropriate consistent with the requirements of the law.
IV. BACKGROUND
On December 5, 2023, the City Council awarded a Construction Contract to HZS Engineering, Inc. for $113,700.00 for Project No. 919: Wilmington Avenue and 223rd Street - Pull Box Access Improvements. City Council also authorized the expenditure of construction contingencies of $11,370.00 (10%) for any unforeseen construction work that may have been necessary to complete this project, for a total budget not to exceed $125,070.00.
In 2019, the City completed the freeway interchange project at the 405 Freeway and Wilmington and during the construction, the contractor installed the pull boxes serving the traffic signal at the intersection of Wilmington and 223rd under the existing Flood Control Channel Bridge owned and operated by the LA County. Due to the current locations, the LA County Traffic Signal Maintenance Division is not able to maintain the traffic signals if it requires maintenance/service. LA County signal maintenance division requested that the City provide accessibility to the pull boxes so that they can maintain the traffic signal at said intersection. The accessibility improvements include the installation of entry gates, metal ladders, concrete landing pads, safety fences with foundation, anchors for safety lanyards, and clearing and grabbing existing vegetation. Demolition and improvement plans were prepared by P.A. Arca Engineering.
The construction of Project No. 919: Wilmington Avenue and 223rd Street - Pull Box Access Improvements, has been completed in a satisfactory manner. Staff is requesting the City Council to accept the project as complete and authorize staff to proceed with the filing of the Notice of Completion.
V. FISCAL IMPACT
None. Measure R funding in the amount of $298,215.90 was allocated in the FY 2023/24 5-Year CIP budget listed under Project No. PW919 in account 254-80-820-904-8009. The contract amount for this project was $113,700.00, with a 10% contingency in the amount of $11,370.00, bringing the total authorized budgeted amount to $125,070.00. The expenditures for this project total $124,502.95, which is $567.05 under budget.
