CONSIDERATION OF RESOLUTION NO. 24-040 APPROVING PROGRAM SUPPLEMENT AGREEMENT NO. A522 TO THE ADMINISTERING AGENCY-STATE MASTER AGREEMENT NO. 07-5403S21 FOR STATE FUNDED PROJECTS FOR PROJECT NO. 1785 [FEDERAL NO. ATPLNI-5403(031)]: BICYCLE MASTER PLAN (CITY COUNCIL)

I.                     SUMMARY

The City of Carson was awarded a grant for Project No. 1785 - Bicycle Master Plan and has been authorized by the State to proceed with the project. The funding for this project is provided by the Active Transportation Program (ATP) State fund.  According to the California Department of Transportation (Caltrans), adoption of a resolution by the City Council approving and authorizing the execution of the Program Supplement Agreement to the Administering Agency-State Master Agreement No. 07-5403S21 between the State and the City is required (Exhibit No. 1). Program Supplement Agreement No. A522 obligates up to $897,000.00 in ATP State funds for the preparation of the Bicycle Master Plan, with no local match required (Exhibit No. 2).

II.                     RECOMMENDATION

Recommendation

TAKE the following action:

WAIVE further reading and ADOPT Resolution No. 24-040, “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, APPROVING PROGRAM SUPPLEMENT NO. A522 TO ADMINISTERING AGENCY-STATE AGREEMENT FOR STATE-FUNDED PROJECTS NO. 07-5403S21 FOR THE CONSTRUCTION - NON-INFRASTRUCTURE PHASE OF FEDERAL PROJECT NO. ATPLNI-5403(031): MASTER BICYCLE PLAN”.

III.                     ALTERNATIVES

1.                     DO NOT ADOPT Resolution No. 24-040. However, if the City does not execute the Program Supplement Agreement, it would not be eligible to receive State funds for this project. No invoices for reimbursement can be submitted to Caltrans until the Program Supplement Agreement is fully executed.

2.                     TAKE another action the City Council deems appropriate.

 

IV.                     BACKGROUND

Project No. 1785 - Bicycle Master Plan will develop a revised Bicycle Master Plan which will serve as an informative guide when developing a framework that improves the city’s physical bicycle system and reduces transportation inequities.

The City of Carson applied for funds for the Bicycle Master Plan in June 2022 through Cycle 6 of the ATP. The city first received notification in January 2023 that Metro was recommending that the full request amount be funded.  The California Transportation Commission approved the funding of $897,000 in June 2023.  The deadline to use the $897,000 fund for the Bicycle Master Plan will be June 30, 2027.

The City of Carson administers State funded projects under the auspices of the current Administering Agency-State Master Agreement between the City of Carson and State of California. An updated version of this Agreement (Master Agreement No. 07-5403S21) is also being presented on this agenda as one of the consent items (File ID No. 2024-0314) for consideration of the City Council.

In order to be eligible for reimbursement, each individual project that is State funded must have a Program Supplement Agreement that is executed by adopting a Resolution. The resolution under consideration would obligate the expenditure of up to $897,000.00 for the preparation of the Bicycle Master Plan, which would be reimbursed through the ATP grant.

V.                     FISCAL IMPACT

The Program Supplemental Agreement under consideration will provide the opportunity for the City of Carson to be reimbursed for an amount not-to-exceed $897,000.00 from the ATP grant for the preparation of the Bicycle Master Plan and is required to appropriate funding for the reimbursable work under the agreement. The ATP grant funds will be utilized next fiscal year (FY) and incorporated into the FY 2024-2025 special revenue funds budget.
