Title
CONSIDER SENATE BILL 272 - MAKING AVAILABLE A CATALOG LIST OF THE CITY'S SOFTWARE SYSTEMS (APPLICATIONS) ON THE CITY'S WEBSITE (CITY COUNCIL)
Body
I. SUMMARY
Senate Bill 272 (SB 272) was approved by California Governor Jerry Brown on October 11, 2015 and was brought to the attention of the Information Technology Manager by City Clerk Gause. SB 272 is an act to add Section 6270.5 to the Government Code, relating to public records the Disclosure of Enterprise System Information for all local agencies (excluding school districts). Because the bill would require local agencies to perform additional duties, the bill would impose a state-mandated local program. This bill would require each local agency, except a local educational agency, in implementing the California Public Records Act, to create a catalog of enterprise systems, as defined, to make the catalog publicly available upon request in the office of the person or officer designated by the agency’s legislative body, and to post the catalog on the local agency’s Internet Web site.
II. RECOMMENDATION
Recommendation
Designate the Office of Information Technology to make available a catalog list of the City’s Enterprise System catalog public and accessible from the City’s website and update the list annually on or before July 1st.

III. ALTERNATIVES

IV. BACKGROUND
Senate Bill 272 requires local agencies (excluding school districts) to create catalogs of all enterprise systems that store information about the public, and to post this catalog on their websites, if they have websites. If they do not have a website, they are required to publish the catalog in a way that can be provided to anyone who asks. This law applies to all California special districts, cities and counties, and compliance is required by July 1, 2016. The California Constitution requires local agencies, for the purpose of ensuring public access to the meetings of public bodies and the writings of public officials and agencies, to comply with a statutory enactment that amends or enacts laws relating to public records or open meetings and contains findings demonstrating that the enactment furthers this purpose.
Section 6270.5 defines an enterprise system as a software application or computer system that collects, stores, exchanges, and analyzes information that the agency uses that is:
1. a multi-departmental system or system that contains information collected about the public and a system of record.
V. FISCAL IMPACT
NONE.
