CONSIDERATION TO ACCEPT THE PROJECT AS COMPLETE, PROJECT NO. 1422: BROADWAY INTERSECTION IMPROVEMENTS - TRAFFIC SIGNAL MODIFICATIONS (CITY COUNCIL)

I. SUMMARY
On October 6, 2020, City Council awarded a Construction Contract to Elecnor Belco Electric Inc. for the construction of Project No. 1422: Broadway Intersection Improvements - Traffic Signal Modifications, for a total budget of $1,188.835.00.
On September 7, 2021, the City Council approved specific change orders to address costs that exceeded the project contingency. These costs were incurred due to various unforeseen challenges during construction.
This project has been completed in accordance with the approved plans and specifications. It is requested that the City Council accept the work as complete and authorize staff to file the Notice of Completion with the Los Angeles County Registrar-Recorder / County Clerk Office under Civil Code Section 9204.
II. RECOMMENDATION
Recommendation
TAKE the following actions:
1. ACCEPT as complete Project No. 1422: Broadway Intersection Improvements - Traffic Signal Modifications.
2. AUTHORIZE staff to file a Notice of Completion.

III. ALTERNATIVES
1. DO NOT ACCEPT the project as complete. However, acceptance of a project as complete and recordation of a Notice of Completion after work completion under Civil Code Section 9204 will shorten the time period during which any contractor will be able to file a lien claim.
2. TAKE another action the City Council deems appropriate consistent with the requirements of the law.
IV. BACKGROUND
On October 6, 2020, the City Council approved Item No. 20, awarding a Construction Contract to Belco Electric Inc. for $1,188.835.00. This contract pertains to the construction of Project No. 1422: Broadway Intersection Improvements - Traffic Signal Modifications. Additionally, the City Council authorized the allocation of construction contingencies, amounting to $118,883.50 (10%).
The project improved the operation, efficiency, and visibility of five signalized intersections by upgrading the signal lights, poles and mast arms, and other related traffic signal equipment that is located on Broadway between Alondra Boulevard and Victoria Street. Broadway is a major north-south four lane arterial truck route that is adjacent to heavy and light industrial land uses with some commercial establishments. The length of the corridor is 1.5 miles, and the signalized intersections include the following locations:
1. Alondra Boulevard at Broadway
2. Gardena Boulevard at Broadway
3. Albertoni Street at Broadway
4. Pedestrian Crossing (south of Albertoni Street) at Broadway
5. Victoria Street at Broadway
Subsequently, on September 7, 2021, the City Council approved and ratified certain change orders amounting to $90,000.00, bringing the new project budget to $1,397,718.50. These change orders were necessary to cover the costs incurred due to various unforeseen challenges during construction, as the project contingency was exceeded. Notably among these challenges were additional foundation removal, unmarked utility lines, conduits, and material price increases. Consequently, the total cost for this project is $1,386,065.63.
The construction has been completed in a satisfactory manner and the traffic signals are functioning as intended for public use. Staff is requesting the City Council to accept the project as complete and authorize staff to proceed with the filing of Notice of Completion.
V. FISCAL IMPACT
No fiscal impact on the General Fund or Special Revenue budgets is associated with the recommended action items. The total contract amount for this project was $1,397,718.50, including a 10% contingency, funded by Measure R, Measure M, and Metro MTA. The expenditures for this project totaled $1,386,065.63 with a budget savings of $11,652.87.
