III.                     ALTERNATIVES

1.                     TAKE such action as the Council deems appropriate consistent with the requirements of law.

IV.                     BACKGROUND

The City of Carson has twenty three (23) Commissions, Committees and Boards that review and make recommendations to the City Council on a wide variety of topics and areas of specialty.  Generally members’ terms run from December 1 of a Council election year to November 30 of the following Council election year.  Members are recommended by the Mayor and ratified by the City Council.

CCBs vary in terms of size and whether or not they have alternate members.  Most but not all CCBs pay their members a stipend for attending meetings.  Some CCBs were created by ordinance and some by resolution. 

This action would standardize most CCBs in the City of Carson to five members and would also eliminate alternate members from most commissions.  This is keeping in line with the practice of most cities.  Two, the Economic Development Commission and the General Plan Advisory Committee would be reduced to seven members and no alternates; the Women’s Issue Commission would remain the same except for the elimination of alternates.

Also, the amendment to the Resolution on the Measure “C” Budget Oversight Committee also changes its name from the UUT Budget Oversight Committee.

CCBs that would be unaffected by the action are: 1) the Public Relations Commission; 2) the Mobilehome Park Rental Review Board; 3) the Senior Citizens Advisory Commission; 4) the Veterans Affairs Commission; and 5), the Youth Commission.

If the City Council adopts the changes in the ordinance, it is important to note that there would be a first and second reading of the ordinances and then 30 days before such ordinances become effective.  If members are removed from CCBs prior to the effective dates of the ordinances, it could create problems for meeting quorum requirements for many CCBs, especially those that are larger bodies today, since they will operate under their existing structure until then.  This could be in March at the earliest.

ISSUES REQUIRING FURTHER COUNCIL DIRECTION:

Further Council direction is necessary regarding the membership composition of the Human Relations Commission and the Community Civic Engagement Board  in order to resolve inconsistencies that will otherwise result from the Council’s direction to reduce the membership of the bodies. Specifically:

                     Human Relations Commission: Carson Municipal Code Section 2762 provides that the Human Relations Commission shall consist of nine regular members, including seven general members and two youth members. It then discusses appointment and qualification standards for the youth members. Per Council direction, the attached ordinance reduces the membership of the commission to five regular members (and eliminates the three alternates). However, it is unclear whether the Council wishes to retain any of the youth members, or whether the five remaining members will all be general (non-youth) members. Further Council direction is requested to enable the City Attorney’s office to revise the ordinance to clarify CMC Section 2762 regarding whether the remaining five regular member positions will include any youth members.

 

                     Community Civic Engagement Board:  Resolution 11-070, by which the City Council created the Community Civic Engagement Board, provides that the Board shall consist of 11 members, including six general members, two CSU Dominguez Hills representative members, one youth member, one senior member, and one community special needs advocate (with no alternates). Per Council direction, the attached ordinance reduces the membership of the board to five regular members. However, it is unclear which membership classifications the Council wishes to eliminate. As currently drafted, the ordinance is internally inconsistent because it states that the board shall consist of five members, but then specifies membership classifications (e.g. general members, CSUDH members, youth member, etc.), all of which are required to serve the board, totaling 11 positions. Further Council direction is requested to enable the City Attorney’s office to amend the membership classification provisions of the ordinance such that the total number of member positions reflected by the classifications is five. 

V.                     FISCAL IMPACT

There would be a net savings from a fewer number of stipends paid to commissioners due to their being fewer commissioners.  It could save the City between $10,000 and $15,000 per year.
